(45,788 posts)The prototype for Section 871 was the British Treason Act 1351, which made it a crime to "compass or imagine" the death of the King. Convictions under 18 U.S.C. § 871 have been sustained for declaring that "President Wilson ought to be killed. It is a wonder some one has not done it already. If I had an opportunity, I would do it myself.";[3] and for declaring that "Wilson is a wooden-headed son of a bitch. I wish Wilson was in hell, and if I had the power I would put him there."[4] In a later era, a conviction was sustained for displaying posters urging passersby to "hang [President] Roosevelt".[5] There has been some controversy among the federal appellate courts as to how the term "willfully" should be interpreted. Traditional legal interpretations of the term are reflected by Black's Law Dictionary's definition, which includes descriptions such as "malicious, done with evil intent, or with a bad motive or purpose," but most courts have adopted a more easily-proven standard. For instance, the U.S. Court of Appeals for the Seventh Circuit held that a threat was knowingly made if the maker comprehended the meaning of the words uttered by him. It was willingly made, if in addition to comprehending the meaning of his words, the maker voluntarily and intentionally uttered them as a declaration of apparent determination to carry them into execution.[6] According to the U.S. Attorney's Manual, "Of the individuals who come to the Secret Service's attention as creating a possible danger to one of their protectees, approximately 75 percent are mentally ill."[2]

(45,788 posts)Threatening the President of the United States
From Wikipedia, the free encyclopedia
Someone needs to assassinate Obama...like ASAP #DieYouPieceOfShit
http://en.wikipedia.org/wiki/Threatening_the_President_of_the_United_States
Threatening the President of the United States is a class D felony under United States Code Title 18, Section 871. It consists of knowingly and willfully mailing or otherwise making "any threat to take the life of, to kidnap, or to inflict bodily harm upon the President of the United States". The United States Secret Service investigates suspected violations of this law and monitors those who have a history of threatening the President.
Because the offense consists of pure speech, the courts have issued rulings attempting to balance the government's interest in protecting the President with free speech rights under the First Amendment to the Constitution of the United States. According to Stalking, Threatening, and Attacking Public Figures, "Hundreds of celebrity howlers threaten the President of the United States every year, sometimes because they disagree with his policies, but more often just because he is the President."[1]
The United States Attorneys' Manual states that the Terrorism and Violent Crime Section has supervisory authority over Section 871 cases.[2]
The prototype for Section 871 was the British Treason Act 1351, which made it a crime to "compass or imagine" the death of the King. (12,647 posts)Who lived with his dad in Tennessee. Said son wrote a nasty letter to one "Pres." GW Bush wishing him all sorts of nasty events that would not end necissarily in his death, but in severe, perminant pain at least because he had stolen the election and was already acting like a complete tool of Cheney.
A week or so later, the boy then got on his Baptist church school bus to take the annual spring class visit to DC. In Virginia, the Secret Service stopped the bus, found the boy, and pulled him off the bus for questioning, then sent him home, warning him never to come within 5 miles of Bush or Cheney, and to never come near the White House unless given permission by them.
This came back to haunt him when he wanted to follow in his mother's footsteps and join the Navy 6 years later.
So, yes - they generally take things like this seriously at least the first time. My understanding is that if the Secret Service investigates and find out the poster is a fool or mentally ill, they usually just make a note and have the FBI keep them under loose observation.

Guess you don't remember what Hinkley did or why he did it? He shot President Reagan, to "impress" Jody Foster. You have no idea who is in that girl's life, and what he might do. But I hope the the Secret Service looks closely at who she is hanging out with.

(32,324 posts)and brain function the other night.
I caught his show while channel surfing; normally I avoid it. But he had information on how the brain develops. Apparently the corpus collosum (Spelling?) disengages from full activity during the adolescent phase of life. It actually switches off. Located in the pre-frontal area of the brain, it is the center that when functioning in a normal way, provides us with logic. When not functioning normally, people can be easily aroused to being very very angry and/or stupid.
And as a result, the amygdala (spelling?) around the side and back of the brain has more power. This brain center is where fear is processed.
He was saying, and other experts he had on the show with him concurred, that this is a time when teenagers need adult guidance, because their brains are working so differently.
Their judgement is altered, and then the other tendency, that of teens eager to drink or engage in drug use, also adds to the amount of mis-judgements they make.

Either way, there will be repercussions, and well-deserved. I'm just saying that if every 16 year old had their lives destroyed because they posted something insanely stupid, nobody would make it to their second decade.
She wanted attention, she's going to get it and HOPEFULLY learn that what she posted is simply not allowed.

(3,424 posts)I think this should be taken very seriously. Even if she may not be considered a direct threat, we know full well how someone who really is capable of this could be set off to act upon it. All we have to do is think of Gabby Gifffords to know that.
And I don't agree with the idea that a teenager's mind (if that's what this person truly is) is not developed enough to realize the seriousness of this. If someone asked a group of eight year olds if they thought this is wrong, most would truly understand and say Yes!

(51,311 posts)http://pulsefeedz.com/alyssa-douglas-may-soon-become-the-most-hated-woman-in-america/
Alyssa Douglas is a 16-year-old Caucasian girl who might have just ruined her life. Shes a hairdresser and a high schooler just trying to live a normal life, who will graduate in 2014. But from this day forward, her reputation, her chance at ever getting a job and her life have taken a twisted turn for the worst. Douglas decided to recklessly tweet something which is considered a threat to our national security, and she could be held liable for her actions in a court room or even in a jail cell.
What has gotten into our society for someone to tweet something so venomous and evil? What happened to just disagreeing with each other but always finding a way to compromise and build a stronger union? What happened to respecting the President of the United States no matter what color, party or gender he/she is?
The saddest part about this story is that this type of tweet probably didnt just sprout out of nowhere. Charity begins at home. The way your parents raise you is the way you will go about living your life (most of the time). Its sad that hate mongering like this from the older generation, who are supposed to be responsible role models, has influenced some kids of the younger generation such as Alyssa.
