What happens if there is a 50/50 vote...?

..to call witnesses?

Does the CJ break the tie?

That would mean that 3 Republicans would vote with Democrats, if they all vote for witnesses?

This is probably a more likely scenario than getting 4 Republicans to vote with Democrats?

If the lawyers argued that there was "executive privilege", the CJ could make a ruling on that . However, it would be subject to an over-ride by a simple majority.

What does it look like from your perspective?

That's usually th vp, but in cases of impeachment it's roberts. It's called out in the constitution it will be the cj of scotus.
