The DC National Guard spokesperson unwittingly reveals a huge American problem

While speaking on behalf of the Major General in charge of the DC National Guard regarding using a helicopter to intimidate peaceful protester, the spokesperson said;

""Our highest priority is the safety of our Citizen Soldiers and Airmen who support civil authorities as they perform their duties,”

NO MAJOR GENERAL! Your "highest priority" should be the "safety of AMERICAN CITIZENS and our Constitution"!

The safety of our citizen "Soldiers and Airmen" is definitely a "high" priority, but it should not be your "highest" priority.

That mentality puts your Soldiers and Airmen above the Citizens they are pledged to protect.

It's the same mentality that has infected our police forces around the country. We've placed a higher priority on "their" safety than we have on the safety of the citizens they serve.

You join the military, or the police force to "serve". That service comes with inherent risk. You freely accept that risk...at least I did when I took my Oath.

Of course we want to do all we can to ensure the safety of the military and law enforcement, but that safety should never be our "highest" priority

Words have impact. Making their safety our "highest priority", might explain why some of them think it's OK to beat and murder unarmed civilians.

It might explain why police officers feel that they can shoot at a 10 year old boy with a toy gun within 2 seconds of arriving on the scene... before their squad car had even come to a stop.

It might explain why police officers feel they can choke the life out of a handcuffed man.

It might explain why a couple of your flyboys decided to put American Citizens at risk.

After all, by your own words, the safety of American Citizens is NOT your "highest priority"

If, like the National Guard, or the police, firefighters said that their "highest priority" was their safety, you could envision the following scenario.

They show up at a house fire where 3 children are trapped in a room. In order to ensure the firemen's safety, they don't enter the building to attempt a rescue, they collapse the house on top of the children to help snuff out the fire.

When asked why they had done that, they would say; "I feared for my life"

Instead of what the spokesperson said, how about this..

" Our highest priority is to protect and defend the American people and the Constitution while ensuring the safety of our National Guard Soldiers and Airmen"

Just that subtle change reinforces the mission of the National Guard while still saying that you do things with safety in mind.

Just that subtle change puts protection of the American people as the top priority.

I prepared statements like the one from the DC National Guard.

It's a combination of laziness and a culture that has become all about getting "home to the family".

I always viewed my military service differently.

It was extremely important that I safely get home to my family, but it was more important that Americans get home safely to their families.

We need to change this culture. We need to restore the word "servant" to "public servant".

I'm not saying that police and National Guard don't have a mission to perform.

The protection of American Citizens should be the highest priority.

You need to ask yourself. Why are criminals able to be apprehended all over the world in other democracies without even close to the amount of police killings.

The officers who murdered George Floyd had him restrained. There was no reason for their actions.

They no longer saw him as a citizen due the lawful protection all Americans deserve, even thieves and robbers.

They did not see him as a citizen they are required to protect and serve.

Wed Jun 3, 2020, 12:29 PM
Jun 2020

First of all, I am not an attorney or a Constitutional Scholar. But I think I understand the oath and the limitations to part of the oath.

First the oaths

Active Duty

I, (state name of enlistee), do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; and that I will obey the orders of the President of the United States and the orders of the officers appointed over me, according to regulations and the Uniform Code of Military Justice. (So help me God)."

National Guard:
I, (state name of enlistee), do solemnly swear (or affirm) that I will support and defend the Constitution of the United States and of the State of (applicable state) against all enemies, foreign and domestic; that I will bear true faith and allegiance to them; and that I will obey the orders of the President of the United States and the Governor of (applicable state) and the orders of the officers appointed over me, according to law and regulations. (So help me God)."

Now the Exceptions and there is one
ARTICLE 92 – FAILURE TO OBEY AN ORDER
Failure to obey other lawful order:
Violation of or failure to obey a lawful general order or regulation:

This is a simplistic (non-lawyer) explanation of Article 92 of the UCMJ
Re: Lawful Orders and Unlawful Orders.

Lawful orders are just that lawful.
They don't break any laws or Constitutional rights.

What are Unlawful Orders.
What is considered an unlawful order?

Obviously any order that would require breaking existing law would be an unlawful order. For example, being ordered to go off post and steal someone's car would be breaking the law. In the US, this also includes orders that violate the Constitutional rights of the person carrying out the order.

This is the hard part if you are the solider. IS the order Unlawful.

A soldier can refuse any order at any time they choose to, for any reason, at their own peril for the full consequences of refusing to obey the order. ... A soldier must first presume orders given are lawful unless they are so clearly unlawful that the average individual would readily see they're blatantly unlawful.

Here is the reaction to Trump's using U.S. Military against protesters.

Former Commanders Fault Trump’s Use of Troops Against Protesters

Gen. Martin E. Dempsey, a former chairman of the Joint Chiefs of Staff, wrote on Twitter that “America is not a battleground. Our fellow citizens are not the enemy.” Gen. Tony Thomas, the former head of the Special Operations Command, tweeted: “The ‘battle space’ of America??? Not what America needs to hear … ever, unless we are invaded by an adversary or experience a constitutional failure … ie a Civil War.”

Adm. Mike Mullen, another former chairman, wrote in The Atlantic: “Whatever Trump’s goal in conducting his visit, he laid bare his disdain for the rights of peaceful protest in this country, gave succor to the leaders of other countries who take comfort in our domestic strife, and risked further politicizing the men and women of our armed forces.”

https://www.nytimes.com/2020/06/02/us/politics/military-national-guard-trump-protests.html

Here is the part for every active duty individual or veteran to remember.
I will support and defend the Constitution of the United States against all enemies, foreign and domestic

Their priorities are protection of their power and wealth, and that of their wealthy donors from around the globe (not just rich Americans).

Another parallel is Republican blind obedience to the authoritarian structures in their Party, like many in the military.

Fundamental facts:
** Republicans cannot govern.
** You cannot lead an organization you're trying to destroy.
** Republicans answer only to their wealthy, plutocratic masters.

Of course no one wants the lives of soldiers, guardsmen, firefighters or police to be thrown away on unnecessary risks to support unwise policy. But the idea that their safety should be preserved while they are in the process of threatening the lives and freedoms of American citizens is absolutely morally reprehensible.

We --meaning EVERY one of us --are not supposed to have to live in fear of our law enforcement and military. The though of such a condition afflicting millions of citizens in this country is the antithesis of what our government is supposed to represent.

We are citizens; not subjects. But over and over again, the police in this country seem to demand the subjugation of black Americans at any given moment.

I think Biden should suggest a court marshall of every single officer involved in these actions. This might send a message to the senior officers who are rolling over on this to contemplate that the final line in their military record will be "He gave illegal orders to attack American citizens on American soil. 10 years in the Brig and a Dishonerable Discharge."

Are the prime requirements for joining any band of government sanctioned thugs a lack of moral code and deep seated sadism?

Aptitude test, question 1:
Q: You have a spider. How many legs do you rip off?
Best Answer: All the ones on one side. Then watch it walk around in circles.

Question 2:
Q: You are sent to a scene of civilian rioting. What do you do?
Best Answer: Bash heads, break bones, spray the pepper stuff. Look for anyone holding anything that looks like a gun, and shoot first. Great time to be had by all!
