Dear Justice Scalia

Dear Justice Scalia,

Laws prohibiting gay marriage, just as laws prohibiting interracial marriage, become unconstitutional upon their formation because the right to marry as we please is a right protected by the 9th Amendment to the Constitution, which states: "The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people." The 14th Amendment is superfluous in this sense, we live in a country of "life, liberty and the pursuit of happiness" and not a totalitarian dictatorship where the arbitrary supposed rights of the state supersedes the natural rights of the people.
