I am no lawyer, but I think tje constitution trumps it. And some folks have been looking for literally anything to go after Obama. I do not agree with a few of the policies, but I think Art. 2 trumps some of the legislation passed by congress to prevent the closure of Gitmo

When Dennis Kucinich tried to sue the President over a similar violation with Libya, involving the War Powers Act, it was thrown out because as a member of Congress he couldn't demonstrate sufficient standing to bring the lawsuit.
I doubt anyone could to sue the President over this matter either.

(24,721 posts)I'm watching the Last Word right now, seeing a clip of some extremists enacting their own "civil war" against the government, with scads of young children on the front lines using wooden stakes for weapons. It's just another reminder of how our country is getting more & more irrational due to unchecked, over-the-top Republican rhetoric. This nuttiness could have been prevented, had Bush/Cheney been held accountable for their actions. Their shoot-from-the-hip way of doing business would have been properly nipped in the bud & stigmatized as creepy.
