Michael Dunn to be retried for murder in Sept. in loud music shooting

JACKSONVILLE --

Michael Dunn, the Central Florida man accused of shooting and killing a teenager during an argument over loud music at a Jacksonville gas station in 2012, will face a second murder trial after an original jury deadlocked on the charge earlier this year.

A judge in Jacksonville ruled Monday that Dunn will be tried again starting Sept. 22, 2014.

In February, a jury deadlocked on the first-degree murder count, but convicted Dunn of three counts of attempted murder for shooting at his companions.

Judge Russell Healey said Monday that Dunn won't be sentenced on the attempted murder counts until after his second trial. Healey says testimony gathered for the sentencing could taint the second trial.

When I heard about the case it was pretty clear he was guilty; claims of "I thought I saw the other guy reach for a gun" not withstanding. What the State did not seem to establish was that he initiated the confrontation with the intent to cause serious bodily harm or death. Not sure why they didn't go with a lesser degree of Homicide other than the intense media scrutiny and political pressure. JMHO, of course.

over and said they hung on self defense. She believed he was guilty.

On the murder charge, Valerie said the jury split over the issue of self-defense.

Florida law says the use of deadly force is justifiable if someone reasonably believes that the force is necessary to prevent imminent death or great bodily harm.

In his testimony, Dunn insisted that Davis threatened him and that he saw a gun. Police never recovered a weapon.

Valerie said the jury's first vote was 10-2 in favor of a murder conviction. Over nearly 30 hours of deliberations, the vote became 9-3.
