Kelvin L. Smith was a free man Feb. 27, 2004, after serving just 2½ years in prison for his part in a brutal north Omaha gang rape.

Within months of leaving prison, he met his next victims: two children.

Smith was found guilty this week of 11 sex-related crimes against the young girls. The crimes, which took place in La Vista and Bellevue, included first-degree sexual assault of a child and third-degree sexual assault of a child.

Unlike with his first conviction, prosecutors had to argue the case to a jury, and the trial in Sarpy County District Court spanned seven days. The two girls, who were 9 and 10 years old when the assaults started, testified against Smith.

I think he's so heinous that he might merit study while in prison. Maybe there is something new we could learn.

It was done...before those subjected were known to be more violent and sometimes suicidal. ..maybe we should whip him in town square and leave him in the stockade so kids can throw rotten tomatoes at him...then hang him at the county fair.

And you are the one bringing up public stocks, etc, not me.
My concern is also for whom he might rape in prison. Or has DU changed its position on prisoner-on-prisoner rape, especially victims who are nonviolent offenders?

The procedure you are describing doesn't help and usually results in someone who is far more dangerous.

In India if you are convicted of more than 1 sexual assault it's the death penalty. Since this man has already been convicted of rape and raped two more children he would be dead if he were in India.

Why should we put up with scum like this? He proved twice that he is a danger to society. There is zero chance that he feels any remorse. Should we really feed and house this guy for the rest of his natural life? Fuck no.

All his victims survived.

I think that one of the few sound arguments in favour of the death penalty (and even so, I'm against it) is that it creates an incentive for rapists and thieves not to murder their victims.

But I'd rather it create a incentive to not rape, at all. The penalty for any cases of rape will do that - Make the punishment for the crime so severe, and your average criminal won't even think about doing it.

But at the very least, we need to look into castration as a punishment for any type of sex crimes.

The punishment for rape, as for any other serious crime, should be a prison sentence.

Incidentally, my understanding is that the deterrent effect of punishment scales far better with likelihood than with severity. Harsher sentences for convicted rapists would do some good, but not nearly as much as a higher conviction rate.

2-1/2 years. And they were raping her two at a time. You can figure out the gory details yourself on that one. Just goes to demonstrate, once again, that rape is STILL a good ole boy crime -- boys will be boys, don't 'cha know. If he would have served REAL time, say 25 to life, those girls would not have been his victims. And who knows how many more are out there.

You brought up another good point -- I doubt these two little girls and the woman victim of the gang rape are his only victims.

People are shocked when I talk about this but *I* didn't do anything wrong *I* have nothing to be ashamed of. *I* reported him. *I* went to court. *I* pressed charges. The asshole actually threatened my life IN the courtroom during the hearing IN FRONT OF THE JUDGE. I was ushered out and when I returned they had him shackled to the chair with a sheriff on either side of him. The charges were plea bargained (without my knowledge or consent) and he was given one year in a drug rehab center. He screwed up while he was there, got violent, and they gave him another year. WITHIN SIX MONTHS after he was released, he attacked another woman and this time beat her so bad she had broken ribs, a broken jaw and was in a coma for 3 days. I was out of my mind with anger because that never should have happened to her! They FINALLY gave him some real time after that and the son of a bitch died in prison. This was in 1984 and I can see that the crime of rape is STILL being treated in exactly the same way.

Police actually called my rapist, a stranger who broke into my home, a "gentleman rapist" because he didn't bloody me up too much.

He went to prison because another victim was able to identify him; I wasn't. He stole about four years of my life; that's how long I was still dealing with the assault on a day-to-day basis.

prosecution plea bargained with the excuse they felt the case was weak? I always wonder
when I hear a story like this..was it a weak case, or is it a reflection of our society indifference
to the crime? One year? I mean what the hell is that..he was threatening you in front of a
judge, what does that tell you about his intent and inability to control himself?

for sexual assaults. Back when I used to read the paper a lot, it would drive me nuts the number of stories I came across where someone raped a child and only got 2 years in prison. I really don't understand why this is accepted.

I am not sure what the minimum should be, but it should certainly be north of 5 years for a first offense.

These one and two year sentences are ridiculous.

... people convicted on relatively minor, non-violent "drug offenses" have packed our prisons far beyond capacity.

And poisonous animals like this are released on the public virtually each and every day.
