I expect "he was lying in dark clothing on a street at night" doesn't constitute a foolproof defense struggle4progress Jun 2014 #3

How did the guy who got hit wind up lying in the street? My spider sense tingles- it tells me he wasn't playing the Wounded Gazelle Gambit.

to a complaint one has run somebody over, but "I was lying in dark clothing on a street at night, minding my own business, when suddenly for no reason this car unexpectedly drove into me" might not be an open-and-shut complaint

I hope the guy recovers. I wonder why he lay down in the street

It could be anything from having been assaulted by somebody else earlier and left there to having passed out after some sort of binge.

My guesses might be either that he was quite intoxicated or had some serious medical event like a stroke or heart attack

to any car with fuctional headlights...and I'd have to wonder if it's that hard to stop when you're driving at 10 MPH.
