PA Officer Arrest Brother of man getting arrested for filming him.

They seize my phone and play the video, which has audio obviously. I am then arrested for audio taping them without their consent (Wiretapping Law), which according to the ACLU does not apply to officers doing their regular duties in public. So I’m arrested as well. Eventually my friend calls his police officer friend who talks with the arresting officer. Then we are both released as long as we give them the video and delete it. So they continue to seize my phone and make us follow them back to the station to transfer the file. After not being able to transfer it due to software issues the original officer takes a video of my video with his iPhone. I am then told to delete the video so I stealthy slide to the next video, which the arresting officer created while seizing my phone (he had no idea how to use a smartphone) and deleted that one. Now I’m sharing this ridiculous video of a cop on a power trip arresting innocent civilians after they visited a 9/11 memorial."

This is how people walking to work end up in jail on a resisting arrest charge. They come up, aske for ID for no real reson and then if you question the legality of them just walking up and harassing you, they arrest you for resisting arrest. I'm glad they didn't plant 'evidence' on you guys. Imagine if you all had jaywalked.

The other guy showed ID and he didn't get arrested.

Every time I get pulled over, they ask for my ID. It's the first thing I reach for...

to prove that you are doing so legally. Why should I need to provide ID if I'm in a public space doing nothing possibly considered illegal?

Don't buy into the security state BS because you may find yourself bent over before you can grab the KY!

Last time I checked, motorcycles require a driver's license. I have a motorcycle license. I wouldn't dream of antagonizing the cops by refusing to show it during a traffic stop.

I do whatever I can to get away from cops as quickly as possible. That includes complying with a request for ID when asked.

Cuz' when I ride my bike I have to sit on it. Now they do LOOK like they may have ridden but that isn't the same, is it? Can the cops assume you have driven if your car is in the parking lot of a bar? How about if it's parked in your driveway and you are standing in your yard?

...to ask why there is a difference in reaction to the action of not operating a motor vehicle? If I wear a space helmet can the cops just assume I have a spaceship hidden?

-Yes. Pennsylvania law forbids audio recordings of what people say without their permission if they have a reasonable expectation of privacy, but that does not apply to police who are performing official duties in public. Police also can record or photograph demonstrators......

-Not in Pennsylvania. If you are detained or arrested, you may choose to show ID when police demand it. If you choose not to show ID, you could be detained for a longer time while police attempt to identify you. If you are an undocumented immigrant, showing your ID may result in your detention by immigration authorities.

...I appreciate your effort. I'm a little surprised that you cited infowars instead of a Pennsylvania government website but, regardless, my question to you is this:

Are you saying that people in Pennsylvania don't have to show ID during a traffic stop?


That surprises me but I guess anything is possible.

while the cops determine your identity.

In any case, while I find it annoying as hell to get stopped at a cop checkpoint for no reason I'm not stupid enough to argue with them about showing my driver's license.

HOWEVER, these cops do need to learn the law about video/photography in public.

You don't have to show ID.

But you should be prepared to be taken to the police station while they try to figure out who you are.

All things considered, it's faster and easier to show ID and I've always simply done that.

in your car by a police officer...
Police officers may ask for your name, driver’s license,
vehicle registration and proof of insurance. You must
show these documents if you have them.

You do not have to answer any other questions or show
any other documents.

I'm guessing this law applies to operators of any licensed vehicle, including motorcycles. These guys were clearly riding motorcycles because you can see at least one of the motorcycles in the video and one of the guys is holding his helmet.

This law wouldn't apply to a passenger not in control of the bike.

If you are walking and not suspected of a crime, you have to tell them your name.

If you are being arrested, you have to identify with id or face being held at their discretion while they do fingerprints etc. to identify you.


And no they can't arrest you for video taping them. If they used that as the sole justification you have a lawsuit.
