The House speaker trumpeted his plans Wednesday to file a suit against the president over his king-like executive orders. But legal experts say one doctrine may stand in the way.
John Boehner is ready to sue President Obama, but the House speaker may not be able to make it through the courthouse doors.
Boehner announced Wednesday that he would sue the president for his failure to faithfully execute the laws of this country. In the opinion of the speaker, according to a memo he circulated, Obamas reliance on executive orders meant that he was acting with king-like authority at the expense of the American people and their elected legislators. As a result, Boehner said, he planned to sue the president over executive orders to be named later under the aegis of a resolution passed by the House of Representatives.
But Boehner may not be able to do so. According to Erwin Chemerinsky, the dean of the University of California, Irvine Law School, the speaker of the House does not have the ability to sue the president in this situation, even if Congress says he does. Chemerinsky says standing, the doctrine that allows a person to file a lawsuit in federal court by demonstrating that real harm has been caused to them, is defined by the Constitution. As a result, even if Congress passes a law, or in this case a resolution, which only requires approval by the House, it will not be binding on federal courts, as the Constitution trumps any law, let alone a resolution, and does not give members of Congress the ability to sue if they cannot prove real harm.

Republicans engage in massive obstructionism for 5+ years- they relentlessly block UP-OR-DOWN VOTES on nearly every piece of legislation and nominee- that ensures that nothing much gets done and then they have the chutzpah to file a lawsuit over the lawful use of executive orders and executive decision-making? Congressional Republicans really are lost at this point. A much better use of their time would be to actually try to get stuff done but they won't. A lawsuit is also dumb just because the Constitution already has a procedure for Congress to reign in a supposedly law-breaking POTUS and it's called "impeachment", which the Republicans don't apparently have the balls to try even though many of them like to fantasize about it in public and claim that they would do it only if they could think of some "high crime and misdemeanor" to charge President Obama with. Yet, they are filing a lawsuit that claims that he is trampling the Constitution but Boehner doesn't even have an example to cite and I don't have a clue as to what he is trying to accomplish with the lawsuit. It's all just bats**t insane crazy with the GOP now.
BTW I am not advocating impeachment, just pointing out that it is really the more appropriate "tool" for Congress to deal with POTUS.

WASHINGTON -- As President Barack Obama was celebrating his inauguration at various balls, top Republican lawmakers and strategists were conjuring up ways to submarine his presidency at a private dinner in Washington.
The event -- which provides a telling revelation for how quickly the post-election climate soured -- serves as the prologue of Robert Draper's much-discussed and heavily-reported new book, "Do Not Ask What Good We Do: Inside the U.S. House of Representatives."
According to Draper, the guest list that night (which was just over 15 people in total) included Republican Reps. Eric Cantor (Va.), Kevin McCarthy (Calif.), Paul Ryan (Wis.), Pete Sessions (Texas), Jeb Hensarling (Texas), Pete Hoekstra (Mich.) and Dan Lungren (Calif.), along with Republican Sens. Jim DeMint (S.C.), Jon Kyl (Ariz.), Tom Coburn (Okla.), John Ensign (Nev.) and Bob Corker (Tenn.). The non-lawmakers present included Newt Gingrich, several years removed from his presidential campaign, and Frank Luntz, the long-time Republican wordsmith. Notably absent were Senate Minority Leader Mitch McConnell (R-Ky.) and House Minority Leader John Boehner (R-Ohio) -- who, Draper writes, had an acrimonious relationship with Luntz.
For several hours in the Caucus Room (a high-end D.C. establishment), the book says they plotted out ways to not just win back political power, but to also put the brakes on Obama's legislative platform.

(82,849 posts)I'll give John Boehner this: He's not a total nincompoop. He's not invoking that Republican trope "the will of the people." I'm not sure why; truth really hasn't been the basis for Republican operations for three decades or more. But since Obama was returned to office with more than 50% of the popular vote, the Senate is in Democratic hands, and Democratic congresspersons received more total votes than those holding Republican seats, it's clear that the Republicans are fighting a rearguard action in defense of a status quo that doesn't serve the broader interests of the country.
So, what does Boehner have? The empty threat of a frivolous lawsuit. I'm shaking in my boots.

Weve all heard the news that John Boehner was filing suit against President Obama, citing that the President was abusing his ability to issue executive orders. The Democratic response to that was overwhelming raising over $584,000 in a single day!
Critics argue that Boehner does not even have the ability to sue Obama over his actions of utilizing the Executive Orders, which is what the President has had to resort to in order to circumvent a do-nothing Congress. This Congress is the least productive Congress in the history of the United States - due to the high partisanship and the undermining efforts for any type of progress by the Tea Party.
The argument about abuse of the Executive Orders falls flat when backed against numbers. It appears that President Obama, with 182 EOs, still has to sign off on another 100 Executive Orders before he even comes close to tying with George W. Bush whose record stands at 291. And Bush Jr. pales in comparison to Ronald Reagan who must have been the great usurper of the Constitution with his Executive Order count standing at 381!
This is just another glaring example of the hypocrisy and overt racism ruled by those on the right.
