the constitution does not set a number or in theory prevent the practice but it won't work with the current make up. Too many conservative Democrats and even with those not so politically conservative there are a great many too process conservative. Also, the reality is Obama is beat down (or playing such on TV) and is appointing out right wingers for lower courts as is, giving great deference to Senators that is not required and has been ignored in the past and will be again when a TeaPubliKlan is pResident.
