12 year old girl arrested for pinching boy's butt at school

LONGWOOD, Fla. - A 12-year-old was arrested and facing misdemeanor battery charges after pinching a boy's butt in school.

The incident was reported at Milwee Middle School on Ronald Reagan Boulevard in Longwood two weeks ago in between classes.

Breana Evans, 12, told News 6 pinching someone's butt and laughing at their reaction is a game that a lot of people play at the school and that she thought it was a joke.

"I regret it because I didn't know it would lead to this," Evans told News 6. "I feel like it's just stupid just a stupid charge that shouldn't have to happen."

According to the report, after the initial incident, the boy told the school resource deputy he didn't want to press charges and Evans was suspended. Evans said she didn't know the boy

But last week, the boy's mother got involved, calling deputies and saying that she wanted to prosecute Evans for battery.

"Lord lord lordy what has this world come to -- kids can't even be a kid and that's basically what it is -- she's 12 years old she was acting like a 12 year old child," said Evans' father, Ray.

Some punk-ass "hard guy" would come up behind you and slip his finger in the loop, then shout "FRUIT LOOP!!" You could either pull away, ripping off the loop or let him do it.

I remember this happening in junior high--8th and 9th grades. I told my 18-year-old son about the "hard guys" (hair combed back, smoked cigarettes, wore Pendleton shirts, Levis jeans, and boot-like shoes with hard heels so they could "click" through the hallways), and how many of them "disappeared" during the summer between junior- and senior-high school--probably shipped off to an "alternative high school." My son found my stories amusing, but I was glad to be rid of them!

The purging of the hard guys made high school a lot more tolerable!

Zimmerman didn't pinch anyone's butt.

All he did was murder a black child in cold blood. Hell, that's barely a misdemeanor under the worst of circumstances.

However, she could have been disciplined without pulling the cops into it. Whoever called the cops is clearly nuts and should be removed far away from children.

Girl, I would never dream of pressing charges against a boy who pinched her. I would have a discussion with the school administration and his parents. I fully expect the problem would end there

on his back...and one day I 'happened' to have a straight pin and planned to burst his shirt...

Got sent to Sister Superior and received several slaps on my hand with a ruler...never did that again!

Today in public school I would be arrested for assault...and what would I have learned from that? No more than those slaps on my hand, but the trauma would be ever lasting...

I guess the choice is now corporal punishment in schools or arrests of students for being children!

Hey, slap my hands every day! There should be a limit on what corporal punishment can be...but, the alternative?

It's either kids will be kids - and let them get away with horrible abuses to each other or zero tolerance and if a kid hugs another kid they are suspended for assault.

Ok I have to say...back in my day

kids got away with probably too much bullying, teachers could be heavy handed with punishment, and of course there was stuff I am sure I never heard about.

But there was a line - an unspoken code of conduct that everyone knew when someone had gone too far.

Looking back, I realize how damaging it was to teach girls that when a boy pulls your hair or pushes you "he likes you". But to be honest, I did a lot of stupid stuff to get a boys attention. We also engaged in a fair amount of horseplay and we also hugged it out.

I don't have kids, but I would like to think that if my daughter did this there would be some apologies/detention/whatever. And if this happened to her the same thing - I wouldn't want the boy to be charged with a crime.

Yes, we need to teach consequences but we are losing common sense.

That's the generic caselaw description. I don't know precisely what Florida Statutes say. So, technically, if a 12 year old girl painfully pinches (or maybe not so painfully) a 12 year old boy's butt, it's a simple battery. To which I say, ok, handle it between parents and in the Vice-Principal's office, not with arrests.

784.03?Battery; felony battery.—

(1)(a)?The offense of battery occurs when a person:
1.?Actually and intentionally touches or strikes another person against the will of the other; or
2.?Intentionally causes bodily harm to another person.
(b)?Except as provided in subsection (2), a person who commits battery commits a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083.
(2)?A person who has one prior conviction for battery, aggravated battery, or felony battery and who commits any second or subsequent battery commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084. For purposes of this subsection, “conviction” means a determination of guilt that is the result of a plea or a trial, regardless of whether adjudication is withheld or a plea of nolo contendere is entered.

... as long as we're being completely idiotic.

I think a severe lecture and a time-out would have just about covered it.

This doesn't rise to the same level of crime as, say, towel-snapping in the locker room.

What kind of boy complains about a simple butt-pinch, and what kind of parents go to court over it?

Here's a wild thought: maybe a kid and parents with goddamn good reason.

The facts:

The boy looks feminine. All year he has been subject to taunts. He has asked the school for help and been told exactly what the posters here are saying: "ha ha, kids will be kids, shrug it off." Recently a gang of girls have escalated to physical touching - hands on his thighs and butt, with whispers of "whatsa matter, don't you like girls?". He is helpless and humiliated. The teachers have pretended not to notice the constant bullying. Finally he came home in tears and told his parents the whole story and showed them a bruise across half his ass from the latest "friendly" pinch, given while the girl shoved him into a locker and her friends took pictures.

The girl, of course, is batting her eyes and saying, "gosh, can't he take a joke?"

Okay, I made that up. I could come up with fifty other scenarios in which the so-called pinch was a whole lot more than what Little Miss Innocent is claiming. Do i know the truth? Of course not. But I recognize one-sided click-bait nonsense when I see it.

Been watching both the press and human nature long enough to shake my head at this recurrent phenomenon: people eager to shout their moral outrage, based on personal preconceptions and minimal information. It's stupid. And if the boy is indeed a victim of bad shit, then the outraged "Those parents are morons!" crowd is helping to victimize him.

I suggest we reserve judgment.
