Months after the Obama administration advised school districts that transgender students should be given access to bathrooms based on their gender identity, a federal judge in Texas has blocked the guidance from going into effect for now.
U.S. District Judge Reed O'Connor has granted a preliminary, nationwide injunction in response to a lawsuit filed by Texas and a number of other states.
As we've reported, the lawsuit argues that the guidance from the White House would turn schools "into laboratories for a massive social experiment."
The preliminary injunction would mean that, until that lawsuit works its way through the courts, the "status quo" would be maintained and the guidance could not be considered enforceable.

(17,186 posts)It would seem, a priori, that the Court's jurisdiction would be only over its own District.

(5,325 posts)Federal suits brought in that district come first to that court, but they're still Federal suits in Federal courts.

The U.S. Court of Appeals for the 4th Circuit held in April that the DOEs trans-friendly guidelines were reasonable and legal. And other circuit courts have issued decisions in similar contexts that accept the theory of sex discrimination that OConnor rejects. Does OConnor believe he has the power to reverse the decision of a higher court outside of his circuit? Perhaps he does, because OConnor seems to have confused himself with a one-man Supreme Court. The judge also blocked the federal government from asserting the guidelines carry weight in any litigation, an extraordinarily dubious extension of his jurisdiction as a district judge ...
