Top French court makes initial ruling to suspend burkini ban

Source: Reuters

France's highest administrative court on Friday suspended a ban on full-body burkini swimsuits that has outraged Muslims and opened divisions within the government, pending a definitive ruling.

The Conseil d'Etat gave the ruling following a request from the League of Human Rights to overturn the burkini ban in the Mediterranean town of Villeneuve-Loubet on the grounds it contravenes civil liberties.

The court said in a statement the decree to ban burkinis in Villeneuve-Loubet "seriously, and clearly illegally, breached the fundamental freedoms to come and go, the freedom of beliefs and individual freedom."

Under the French legal system, temporary decisions can be handed down before the court takes more time to prepare a judgment on the underlying legality of the case.

French court suspends 'burkini' ban

France's highest administrative court has suspended a ban on full-body "burkini" swimsuits that was imposed in the town of Villeneuve-Loubet.

It said the ban "seriously and clearly illegally breached fundamental freedoms to come and go, freedom of beliefs and individual freedom".

The ruling could set a precedent for up to 30 other towns that have imposed the ban.

The court will make a final decision on the legality of the bans later.

It was a punitive and retaliatory law that targeted only women. It forced women to disrobe in public. It gave police, who are most likely to be men, the power to order women to reveal themselves for a full body ogling. Let's add body shaming, too.

C'mon, have you seen what people wear at the beach? If the French lawmakers think the public shouldn't see women who are covered, then why should they forced to see some fat old guy in a tiny thong with his junk oozing out?

Women aren't monolithic and we all feel differently about how we dress -- or undress -- at the beach, and for a variety of reasons that have nothing to do with religion . I'm very fair and I burn quickly, so even in a one-piece swimsuit, I still wear a long kaftan or dashiki and a big hat for protection. And whatever the reason, whatever a woman chooses to wear, is no ones business but hers.

As someone else pointed out, the 'ban' didn't include Orthodox Jewish women who also cover at a beach.

I can't stand that these women have to cover up from head to toe, but we shouldn't be telling them what to wear.

I live in an are with a large population of Muslims, and every time I see a woman out covered from head to toe in the extreme heat of Houston I want to scream.

Mostly, only the head is covered, but I am seeing more and more oppressive coverings. ugh

"The French republic is built on a strict separation of church and state, intended to foster equality for all private beliefs."
No, it was not intended to foster equality among private beliefs but to prevent religion to interfere in any way with the affairs of the country like it had for so many centuries. I do not thank the Guardian for propagating the myth of the persecuted religion.
