Trump Says He Won’t Declare National Emergency to Build the Wall…For Now: ‘We Want Congress to Do Its Job’

by Julio Rosas | Jan 11th, 2019, 3:25 pm 324

With the partial government shutdown set to become the longest in U.S. history, President Donald Trump said his administration is no longer looking to declare a national emergency in order to build a wall on the U.S-Mexico border. They instead would, according to accounts of a White House pool spray from multiple reporters, rather have Congress “do its job.”

Trump has been toying with the idea of using declaration and the U.S. Army Corps of Engineers to build the wall, according to ABC News.

UPDATE:

Trump Backs Off: ‘Not Looking’ To Declare National Emergency ‘So Fast’

By Kate Riga
January 11, 2019 3:27 pm

President Donald Trump said Friday that he does not intend to declare a national emergency “so fast,” despite his evident recent delight in threatening to do so.

“I’m not going to do it so fast,” Trump told the White House press pool. “We want Congress to do its job. What we’re not looking to do right now is national emergency.”

He said as recently as Friday morning that he “can’t imagine any reason” why he shouldn’t declare national emergency to get his wall funding.

Inquiring minds want to know.

If there is predicted to be no change in circumstances six months from now, and those future circumstances will be used to justify declaring an emergency then, why is it not an emergency now?

Trump wants to be dictator.

Putin wants to destroy the government of the United States.

One stone, two birds.

Sooner or later, this emergency/not an emergency logic will sink in at the White House, and a LIHOP/MIHOP situation could occur that gives Trump declarative authority that fulfills this wish of his plus the opportunity to strangle democracy in a way that both he and Putin find most satisfying.

And the MAGAbillies will applaud.

The White House legal team told Trump he couldn't declare a National Emergency to get his stupid wall. If he had tried, the legal challenges would have been legion. At least one judge would have issued an injunction freezing any construction. The military could not violate the law on Trump's say-so as it would be an illegal order which they are not obliged to follow.

Add to this mess the problem with so much private land being owned along the border. I have a friend who has a 350-acre ranch on the Arizona/Mexico border. If her land is claimed through Eminent Domain, I guarantee you she will fight tooth and nail through the legal system. I suspect that most land owners would take similar actions. This would tie up any construction for years of litigation.

As usual, Trump is simply trying to make it look like he's magnanimous when, in fact, he's been stymied.

Trump is an idiot.

I know there are 2 branches of Congress and telling the difference between them is hard for people that don't pay a lot of attentions to all that politics stuff. The House has done their job, well sort of. The took a shortcut and passed the same bills that the Senate passed just a month ago. But because the last Congress is over, the Senate now just needs to pass the same bill that all the senators of the last Congress thought was great - all of them voted for it. There are a small handful of new senators that haven't had a chance to vote on the great bill yet, and we know how important it is to Mitch to have new senators vote on bills they haven't had a chance to vote on, he had many, many votes on bills a couple years back that the only reason was to give new senators a chance to record a vote.

But something has happened to Mitch, I think he might be getting senile, he is keeping those senators from voting on a bill that he, himself, voted for just a few weeks ago. What you need to do is pick up the phone (I don't think there are any golf carts to drive you over to his office with the shutdown and all) and tell Mitch to do his job. Mitch needs to produce a bill. That where this whole thing is stalled, not the House. Have Mitch get a bill signed, they will bring it over to you, you sign it and you can go golfing again. Doesn't suck having to stay in that miserable White House? I mean, they don't even have KFC or Big Macs! Talk to Mitch, get him to vote on a bill. trust me, at your age, a couple weeks off the links and your game will go to hell. You'll lose your swing, for Christ sake.

Specifically the Senate, to bring the vote to the bills they'd already approved, and have been passed by the House. McConnell very likely can bring a veto-proof vote; he just refuses to.

If Trump declares a national emergency for boarder security, he sets a precedence for every President who follows him.

When the next President is a Democrat, we will declare that Climate Change is a National Emergency, and proceed to bankrupt every rich Republican business. We will change the world, and there is not a thing the Republicans can do to stop it.

So I wonder what convinced him.

I heard today that the Supreme Court would likely overturn the declaration pretty promptly, based on the actual facts. Perhaps having a list of his lies spelled out in a court decision would be embarrassing for him.

They've had 2 years to do literally anything they want, but apparently this issue became an emergency in late December 2018? And suddenly it's SO urgent that we have to shut down the government. Or declare a state of emergency, which he'll decide at some future time.

Because, emergency.
