NEW YORK (AP) Lawyers for a woman who accuses President Donald Trump of raping her in the 1990s are asking for a DNA sample, seeking to determine whether his genetic material is on a dress she says she wore during the encounter.
Advice columnist E. Jean Carrolls lawyers served notice to a Trump attorney Thursday for Trump to submit a sample on March 2 in Washington for analysis and comparison against unidentified male DNA present on the dress.
Carroll filed a defamation suit against Trump in November after the president denied her allegation. Her lawyer, Roberta Kaplan, then had the black wool coat-style dress tested. A lab report with the legal notice says DNA found on the sleeves was a mix of at least four people, at least one of them male.
Several other people were tested and eliminated as possible contributors to the mix, according to the lab report, which was obtained by The Associated Press. Their names are redacted.

The fact is, she's worn the dress more than once, and she wore it to monetize her allegations. I want Trump gone as much as anyone, but Carroll has done a lot to discredit and needlessly complicate her own lawsuit.

(16,887 posts)I will bet that before she went public, she met with lawyers and they had it tested before the photo shoot in order to be prepared for what they hoped could be brought to trial.
The photo shoot was the PR launch to tell the truth and they let the accused know in advance that there was evidence and it had been preserved and hung up and not worn since.
That was a deliberate and purposeful statement. Jean Carroll is a smart woman with people around her and they made sure when they began this to dot the is and cross the ts. And preserve the chain of evidence.

(53,410 posts)DNA is the same no matter where they take the sample. Thats why all they need is a sample of spit. The question is whether the DNA sample thats on the dress is sperm. If it is they have a case for rape or sexual assault. If it isnt then it just means he left DNA from another type of encounter.

There was a famous blue dress, from back in the day. Maybe it proved a sexual encounter. It had no bearing on consent, or the lack thereof.

This is a civil suit with a different burden of proof than a criminal case.
And this isn't a rape case, it's a defamation case.
All she has to prove is he lied and did so to harm her.

They must've changed the article to clarify that.
According to a longer article in WaPo, "The lab noted that acid phosphatase activity, a 'presumptive indication of the presence of semen,' was not detected."
She's quoted in that article as saying that after not wearing the dress for 25 years, she wore it to the photo-shoot for the NY Mag article about her book.
I'd be kind of surprised if the request is successful.
