GOP lawmakers: Prisoner exchange violated law

Two Republican lawmakers on Saturday accused President Barack Obama of breaking the law by approving the release of five Afghan detainees held at Guantanamo Bay, Cuba, in exchange for a U.S. soldier believed held by Islamist insurgents for five years.

The White House agreed that actions were taken in spite of legal requirements and cited "unique and exigent circumstances" as justification.

Sgt. Bowe Bergdahl, 28, of Hailey, Idaho, was handed over to U.S. special operations forces by the Taliban. In return, five Afghans who were held at a U.S. detention facility in Cuba were released to the custody of the government of Qatar, which served as a go-between in negotiations for the trade.

Rep. Howard "Buck" McKeon of California and Sen. James Inhofe of Oklahoma said in a statement that Obama is required by law to notify Congress 30 days before any terrorists are transferred from the U.S. facility. They said Obama also is required to explain how the threat posed by such terrorists has been substantially mitigated.

The Republicans would no doubt argue that gravity is an imposition on the freedom of any individual who might want to fly without the aid of a mechanical flying machine, just as Obamacare should be repealed because any healthy individual should want the freedom to get sick and die if he chooses.

and explanation that the threat would be mitigated--the law specifically states that the defense secretary had to do all that. So, Hagel alone technically broke the law--I'll bet he probably didn't want to let the same assclown Repubs who are screeching now to have had 30 days to publicize and blow the deal and prevent Bergdahl's release for political reasons. McKeon, Inhofe, McCain didn't WANT this guy home--anything to have a cudgel to bash Obama with.

Have they been charged with anything besides being "bad men". We've had plenty of time to charge and prosecute. Some of the Gitmo prisoners were children when they began their incarceration. Shhhhh...it's a secret.

If there is the tiniest stint of logic among the GOP, they know all they can do is squeal, crash, and burn, will leave it alone and settle for a good cry. But then there are those GOP politicians who don't know shit from apple butter and will walk into a special hole dug for them by their own colleagues.

It's a no win for the GOP no matter what..... that is, outside of supporting the president, and oh how that would be out of character and against their funding racket.

Al Qaeda to keep the American soldier in order to create a kind of "American Held Hostage" scenario designed to embarrass Obama and the Dems. The GOP conspired to keep the hostages in Iran longer for political reasons, there is no reason they would not do the same now.

Section 308 of the the Intelligence AUthorization Act as well as provisions of the National Defense Authorization Act and the Department of Defense appropriations act.

Taken individually and together, they require the President and the Secretary of Defense to notify and/or certify to Congress 30 days in advance of transferring Guantanamo detainees.

The administration does not dispute that they did not follow these provisions. However, the President has consistently taken the position, and has confirmed that position in written signing statements, that the administration regards those requirements as unconstitutional limits on the President's authority and thus are not binding.
