$2M bail for accused killer of Nevada trespasser

SPARKS, Nev. (AP) — Bail was set at $2 million Thursday for a 73-year-old former school teacher charged with murder in the shooting of two unarmed trespassers that is bringing attention to Nevada's "stand your ground" law.

Wayne Burgarello, who cried out at his bail hearing in pain he blamed on inadequate medical care at the county jail, insists he was acting in self-defense in February when he killed a 34-year-old man and seriously wounded a woman he found in a vacant house he owns in Sparks.

Bugarello shot Cody Devine, 34, five times, once in the head, after Burgarello said Devine had raised his arm at him in a threatening manner, police said.

Washoe County prosecutor Bruce Hahn said in Sparks Justice Court on Thursday the evidence will show Devine's "wound track belies his claim of self-defense."

"No other weapons were found," he said.

Is that the gun cowards wrap themselves up in them like a security blanket thinking it will keep them safe from the law while they look for live targets to shoot at.

5. Pennsylvania's SYG law is different

in that in order to "shoot first", the assailant must be armed.

Under the new law, a person in any lawful place outside his home “has no duty to retreat and has the right to stand his ground and use force, including deadly force if . . . (he) believes it is immediately necessary to do so to protect himself against death, serious bodily injury, kidnapping, or sexual intercourse by force or threat.” (18 PA consolidated statutes 505(b)(2.3)).

Mangino says many prosecutors don’t like this law.

“We should not authorize lethal force when someone has the ability to get away from that dangerous situation,” he said.

But it’s the law; although, it’s not the same as Florida’s law.

What makes Pennsylvania’s “stand your ground” statute different from Florida is that before you can stand your ground — that is, not retreat when retreat is possible — and shoot and kill an assailant because you fear severe bodily injury, your assailant must have a lethal weapon.

You're going to have enough of your low information/low intelligence types that are going to think SYG offers them protections that in reality it does not. The victims that will lose their lives to these idiots that didn't know that their state's SYG law was different sadly won't have a say in the matter.

Should we really arm teachers? Can you imagine this guy roaming the halls with a gun? Why not call the cops? These murderers are panting to kill a person...helpless animals and targets are just not as much fun I guess...lock him up and throw away the key.

And if you find someone in your property, why not wait outside while calling the police in? If anyone will be justified in shooting someone in the head multiple times, it would be our illustrious "persons in blue". I would think in this case, they'd go in and arrest the squatters and tell the man to get new locks for the home.

That's the thing with these 2nd amend. people, they seem to be looking for an excuse to use their weapon on someone. To be that "good guy with a gun", and be the hero they think they are in their own minds.... Otherwise, why have they spent so much money on arming themselves and carrying it around for that moment when they can use it? And we see how it can go badly for that so-called "good guy" with the latest incident with the gun nutter's that were on a "revolution starting" path. They shot 2 cops and then the 3rd man because he approached the armed man and didn't realize that there was a second armed shooter. Sadly, the both of them, the "shooters" and the "good guy", more than likely hang out in the same type of chat forums and think that Bundy is a hero and Pres Obama is a zero.

And what was accomplished at the end of the day, cops dead, 2 misguided angry youths dead (no revolution started), and a "good guy" dead. Families saddened at the loss of unnecessary life taken, gun nutter's confused as to whom to defend in the rampage because that is them in both scenarios in their heads, and regular citizens more frightened of living in these states where people wander around with guns in stores and restaurants, affraid of making it back to their home alive. All due to the NRA and people's strange fears of a Federal Govt, a black President, and their white, male existence losing perceived power because of harsh economic times for everyone who isn't a 1%'er. And the NRA has had a ton of help with the existence of hate talk radio, random crack pot conspiracy websites, and Fox News (who calls itself entertainment and then fair and balanced, trusted bees source all at the same time). Fox News legitimizes much of the conspiracies, the loonies, the tea party, and plays off of these people's fears and hate. Plus if you hear any of their politicians speak, a lot of their rhetoric is ginned up to create a base of fear and hate who will work to keep them in power (it seems to be turning on them since 2008 when Sarah Palin helped to legitimize the hate rallies and make it ok for these white enclaves of suburban and rural persons to hate in open).

The types if stuff I hear people say now since Pres Obama has been elected because I'm white, is absolutely disgusting. And if I'm at work and I act shocked or say something like, "no, I don't know what you mean," these people will go to lengths of nastiness like make complaints to the hotel management about the property or write nasty review comments online. When they are caught being racist assholes, they then want to turn it around and act as if I've been offensive or rude. Fox legitimizing these people is dangerous. And they have guns. And they have feeble brains that can be easily motivated into doing and saying the craziest stuff... Just look at Benghazi or now Bowe Bergdhal (a POW that I didn't know much about, but was a darling of the right to pull out of their hat to hate on the President and raise money around.) the 180 spin on Sgt Berhdhal is absolutely mind blowing. The deleted congratulations from Republican Politicians is also rather amusing, but also crazy and terrifying at the same time. They have no back bone.

I am quite concerned over living in FL with SYG laws, concealed weapons, and white people who can visibly see and feel the encroachment of minorities into "their white America". And of course, the real threat to the global citizens of the world are the wealthy people with power and control of how miserable people's lives will be. Middle class societies are losing ground to the greed, those at the bottom end of the rope in developing countries are becoming agitated over worker abuses, and global climate change will only add to the chaos that is already being made by those top wealthy families of the world.
