Bergdahl Back In The US To Continue Recuperation

WASHINGTON (AP) — Bowe Bergdahl, the Army sergeant who has been recovering in Germany after five years as a Taliban captive, returned to the United States early Friday to continue his medical treatment.

A Pentagon spokesman, Navy Rear Adm. John Kirby, said Bergdahl flew to Brooke Army Medical Center in San Antonio from Ramstein Air Base.

While at the Texas Army base, Bergdahl "will continue the next phase of his reintegration process," Kirby said, adding there was no timeline for the process.

"Our focus remains on his health and well-being," he said. Defense Secretary Chuck Hagel "is confident that the Army will continue to ensure that Sgt. Bergdahl receives the care, time and space he needs to complete his recovery and reintegration," the spokesman said in a statement.

The Idaho native was expected to be reunited with his family in San Antonio. He was captured in Afghanistan in June 2009 and released by the Taliban on May 31 in a deal struck by the Obama administration in which five senior Taliban officials were released from detention at Guantanamo Bay, Cuba.

Exclusive: Bergdahl Explains in Prison Letters Why He Vanished

In a pair of letters, the captured U.S. soldier asks his government to reserve judgment about his disappearance—and complains about the officers leading his unit in Afghanistan.


Writing from a Taliban “prison,” Bowe Bergdahl urged his family and his government to wait until they had all the facts before judging him for leaving his base. Then Bergdahl explained, at least in part, why he left his fellow troops in 2009.

“Leadership was lacking, if not non-existent. The conditions were bad and looked to be getting worse for the men that where actuly (sic) the ones risking thier (sic) lives from attack,” he writes in a letter dated March 23, 2013 and obtained by The Daily Beast. It’s one of two letters sent by Bergdahl to his parents during his five years held by the Taliban-allied Haqqani Network in the tribal region of Pakistan.

“If this letter makes it to the U.S.A., tell those involved in the investigation that there are more sides to the cittuwation (sic),” he adds. “Please tell D.C. to wait for all evadince (sic) to come in.”

The copies of the two letters were given to The Daily Beast by sources in contact with the Taliban. U.S. and western officials confirmed they were the same letters delivered by International Red Cross from the Taliban to Bowe Bergdahl’s family. Together, they represent the first comment from Bergdahl himself on the controversy over his departure from his base in June 2009, leading to his capture. Fellow troopers have attacked Bergdahl, saying soldiers were injured and killed as military resources were devoted to the search for him.

Bergdahl was freed last month when the White House agreed to swap him for five senior Taliban members who had been jailed in Guantanamo Bay prison since 2002. The Obama administration has been assailed by Congress for making the trade without notifying them in advance, and for releasing the former Taliban fighters into the custody of Qatar, where they will be allowed to reunite with their families and live fairly freely though they’ll be monitored.

b/c the lunatics are out and about from yours truly the GOP party. Now the party of war want to re-enter Iraqi and gawd forbid if any American Soldiers get capture b/c now their motto is "leave them behind".

I live in San Antonio and I'm concerned about all of the right wing loonies that are here and are being very vocal.

I would imagine, though, that the military knows this and has it well covered. I hope so, in any event. The Bergdahls deserve a quiet and dignified first meeting with their son.

knows what all the facts are regarding his capture and imprisonment and as he was serving his country at the time, I think we owe him the benefit of the doubt until proven otherwise.

delivered by Gerry Condon at the National Press Club, June 10, 2014

"We love you, Sgt. Bergdahl. We have great respect for you and your wonderful family. We are happy that you will be reunited soon!
Veterans For Peace also has a message for President Obama:
Mr. President, I am speaking for thousands of veterans from too many wars. We want you to bring ALL the troops home from Afghanistan! Bring them home now, and take good care of them when they get here.
And Mr. President, it is time to release all the prisoners of war from Guantanamo. End the torture, Shut Down Guantanamo now!
The American people are tired of war. We are ready to live in peace."

While the UCMJ contains some articles unique to military service, others run parallel to civilian law. Under Article 31, SGT Bergdahl has the right against self incrimination. (Introduction of his letter wouldldn't be barred under Article 31, but if coerced, the accuracy can be challenged.) Under Article 32, similar to a grand jury, he has the right to an impartial hearing/investigation to recommend (to the convening authority) whether charges are appropriate or not.

Most importantly, under the UCMJ, there is a presumption of innocence.

SGT Bergdahl also must be fit to stand trial. Available defenses generally resmble those in civilian courts.

For the innocent, the best place to be is a military court. If you are guilty, avoid it at all costs and if you can't avoid it, go with atrial by judge only. The men & women on the court have been there and done that and cut through the bullshit. They can ask questions. If President of the Court Martial doesn't want a question, the members can overrule him/her with a majority vote. While all members of a court martial will outrank the defendant, an enlisted soldier has the right to have 1/3 of the court appointed also from the enlisted ranks.

What you should not expect is a speedy Presidential Pardon. As a potential defendant, SGT Bergdahl has a right to not incriminate himself in Congressional hearings. If he is pardoned, there is no basis on which he could refuse to testify.
