Democrats propose legislation that would force FCC to ban Internet fast lanes

Today the Washington Post reported that Democratic lawmakers in both the Senate and House would unveil legislation aimed to prevent an Internet fast lane.
The proposed bill was introduced by Sen. Patrick Leahy, D-Vt., and Rep. Doris Matsui, D-Calif. It would require the FCC to use its authority to prevent the speeding up of some Internet entities at the expense of others. For example, speeding up a streaming video service at the expense of another Web service. The Post reports:
It wouldnt give the commission new powers, but the bill known as the Online Competition and Consumer Choice Act would give the FCC crucial political cover to prohibit what consumer advocates say would harm startup companies and Internet services by requiring them to pay extra fees to ISPs.
The ban on fast lanes would apply to the connection between consumers and Internet service providers (ISPs), and would fall into current net neutrality rules.

(22,000 posts)But Reid is going to have to try to get 60 votes to get cloture when it comes to the floor. Then of course the Corporate House of Representatives will be much more difficult.

(26,549 posts)The SCOTUS ruled that the FCC can't create a new set of regulations for ISPs. Their choices are allow "fast lanes" or stick ISPs under the old telephone rules. The old telephone rules would hurt - they're based on giving everyone crappy coverage instead of upgrading coverage.
As a result, we need new law from Congress so that the FCC can regulate ISPs as ISPs instead of regulating ISPs as phone companies.
(Whether it's better to regulate them as phone companies in the short run is hard to determine due to all the chaff being thrown about on this issue)
