Boehner Planning House Lawsuit Against Obama Executive Actions

Speaker John A. Boehner, R-Ohio, told Republicans Tuesday he could have an announcement within days on whether the House will file a lawsuit against President Barack Obama, challenging the executive actions that have become the keystone of the administration.
The lawsuit could set up a significant test of constitutional checks and balances, with the legislative branch suing the executive branch for ignoring its mandates, and the judiciary branch deciding the outcome.

Boehner told the House Republican Conference during a closed-door meeting Tuesday morning that he has been consulting with legal scholars and plans to unveil his next steps this week or next, according to sources in the room. Boehner spokesman Michael Steel said further action is necessary because the Senate has not taken up bills passed by the House targeting executive actions. The House has passed a bill expediting court consideration of House resolutions starting lawsuits targeting executive overreach and another mandating that the attorney general notify Congress when the administration decides to take executive action outside of what has been authorized by Congress

It's usually really hard to make something retroactively illegal. Even if the same kind of decision could be applied to the Bush coup endless illegal activity, nobody will prosecute it because they know they'll fall out of the sky one day if they do. That could change one day, but not today.

The issue does have the potential to do us all a huge favor, and I am certain that the President himself is aware of it: it could draw attention to the fact that Republicans in the past armed the Executive Branch with overwhelming and theoretically unlimited power. The White House will win any lawsuit like this because all the President has to do is show the double-secret legislation that gave Dick Cheney whatever the fuck he wanted. That in turn could provoke some restricting legislation that the US desperately needs.

By permitting it to become an issue now, it's possible we could snooker the GOP into trying to reign in executive power in a myopic attempt to hamstring this President whom they hate so much for his blackness. But what they'd in fact be doing for us is ensuring that Jeb Bush won't be able to fuck us all up nearly as bad as his brother did.

You think I'm kidding now, but I"m telling all of you that Jeb is going to destroy everyone in his way, including Hillary Clinton, in order to get close enough to steal it. The Bushes are above the law today, as I said, but many of the crimes they committed have no statute of limitations. Controlling that documentation, and ensuring that the Bushes remain above the law, will be their main priority in 2016, and they have everything riding on it.

no doubt either about Jeb. He is their only chance to stop the momentum we have and save their legacy.

dimson had a lot EA's. I hope if he is successful in this lawsiut that all EA's of all presidents will be AFFECTED. Can't just pick one POTUS to get righteously offended at, I wouldn't think. The RW is stupidly obsessed with making this POTUS look exceedly bad and they just aren't doing it........Boner and the RW are totally losing it.....have lost it.... and are going to lose more.....
