Federal judge strikes down Indiana ban on same-sex marriage

INDIANAPOLIS — A federal judge struck down Indiana’s ban on same-sex marriage Wednesday in a ruling that immediately allows gay couples to wed.

U.S. District Judge Richard Young ruled that the state’s ban violates the U.S. Constitution’s equal-protection clause because it treats same-sex couples differently than couples of opposing genders.

“Same-sex couples, who would otherwise qualify to marry in Indiana, have the right to marry in Indiana,” he wrote. “These couples, when gender and sexual orientation are taken away, are in all respects like the family down the street. The Constitution demands that we treat them as such.”

The clerk in Marion County, home to Indianapolis, says the office will start issuing marriage licenses immediately.

INDIANAPOLIS — A federal district court and a federal appeals court struck down two states' bans on same-sex marriage Wednesday, saying the laws violate the equal protection clause of the Constitution

In Indiana, U.S. District Judge Richard Young did not issue a stay on his ruling, so couples can start marrying immediately. Marion County Clerk Beth White here said she is prepared to issue marriage licenses to same-sex couples in her office downtown.

In Denver, the 10th U.S. Circuit Court of Appeals called Utah's gay marriage ban unconstitutional but immediately put its ruling on hold.

The Indiana attorney general's office said it will appeal and seek a stay.

My former neighbors went to Iowa to get married and now, I am so happy for them...their marriage is now legal in Indiana!

Anyone know how long it took to get in front of the judge?

I'm asking since the gay marriage suit in Georgia was very recent. It's not clear how long it takes for the case to make it to court and the judge to render a decision.

I'm getting antsy

I think the one in Utah is now the closest one to head to S.C.O.T.U.S. Which should get there within the year. And that one just may very well be the one to vacate the rest of the. Keeping fingers crossed.

I know two same-sex couples who recently went out-of-state to get married; one is currently in France after going to NY for a marriage license and wrote on FB, "You mean I could have stayed home?"

And it turns out (contrary to my expectation) that our county is indeed already prepared to issue licenses to same-sex couples (I have no idea whether they've actually done so yet).

To think that just a few months ago the big concern was that the GOP legislature was going to put the ban in the state constitution via a ballot proposal!
