Freedom Industries owners indicted, charged in chemical leak

Four owners and managers of Freedom Industries have been indicted and charged with federal violations of the Clean Water Act for failing to operate the company in an environmentally sound manner, resulting in the chemical leak that contaminated the drinking water of 300,000 people in January.

Dennis P. Farrell, William E. Tis, Charles E. Herzing and Gary L. Southern are each charged with three counts of violating the Clean Water Act.

Each man is charged with failing to meet a “reasonable standard of care” in running the company.

“Their negligence resulted in and caused the discharge of a pollutant, that is, MCHM, from point sources into the Elk River,” according to the indictment, unsealed today by U.S. Magistrate Judge Dwane L. Tinsley.

How much time will they serve? How much will the accompanying fine be for each of them? We need to remember that this is just the indictments. The trials are yet to come. Will they be tried together or singly?

That this article makes no mention of the fact that Freedom Industries is a Koch-owned company as well. The Kochs would never allow their names associated with an indictment in the press!

... it's just the way they (business and Corp M$M) pull the wool over the West Virginians eyes. If someone wrote a LTE explaining to the public what the newspaper accidentally on purpose omitted, I bet you $5 they wouldn't print it. Any takers? All the newspaper did was signify that something happened, but they forgot to fill in the blanks. That's not the way to inform the public.

FBI: Former Freedom president devised scheme to distance himself from company

Gary Southern, the former Freedom Industries president, faces federal charges for allegedly lying about his role at the bankrupt firm to protect his personal fortune from legal actions over the January chemical spill at Freedom’s Elk River facility.

Southern is charged with bankruptcy fraud, false oath in a bankruptcy case and wire fraud, according to a criminal complaint filed Monday in federal court. The complaint was unsealed Monday after it was determined that he had been arrested.

In a sworn affidavit, FBI Special Agent James F. Lafferty II said that Southern’s scheme began shortly after the spill was detected on Jan. 9. Southern allegedly wanted to deflect blame for the spill that contaminated the tap water for 300,000 people and protect himself from lawsuits.

He allegedly engaged in a pattern of deceitful behavior, including making numerous false statements about his role at Freedom, his knowledge about conditions at the Etowah River Terminal, where the MCHM chemical leak originated, and his role in the sale of Freedom to Chemstream on Dec. 6 of 2013, according to the affidavit.
