New York City's soda ban bubbles up to the state's highest court

The city’s high profile battle to ban large sugary sodas reached the state’s highest court Wednesday - and may have found a sweet spot.

Court of Appeals Chief Judge Jonathan Lippman described the Bloomberg era proposal as a “relatively modest regulation” and questioned why it was any different from previous efforts to ban trans fats or add fluoride to water.

“Put aside the hype about what they are doing, what is so revolutionary?” Lippman asked attorney Richard Bress, who represented the American Beverage Association and other opponents of the proposed ban.
