Stiffer penalties proposed for assaulting a process server

Process servers are calling on the Assembly to pass a bill that would create stiffer penalties for those who assault the deliverer.

The bill (S.2599/A.6077) passed the Senate on June 11 with 58 ayes and three abstentions. It was sent to the Codes Committee in the Assembly.

Sen. Catharine Young, D-Olean, sponsors the bill in the Senate that would make it a Class D felony of assault in the second degree if a person assaults a process server.

The bill covers assault on a process server before serving the documents and assault in retaliation after the papers are delivered. According to the bill's language, in recent years there has been an "alarming increase" in attacks on process servers in the state.
