Rev. Al Sharpton Urges Comptroller To Approve $40-Million Settlement For ‘Central Park Five’

NEW YORK(CBSNewYork) — A rally was held on Saturday, in support of five men who were wrongfully convicted in the 1989 Central Park jogger case.

Teenagers at the time, the men were charged with the rape of a 28-year-old woman.

The convictions were overturned in 2002 after DNA evidence was linked to a serial rapist who admitted to the attack.

Comptroller Scott Stringer said on Friday his office has begun to review a proposed $40 million settlement with the Central Park Five.

The New York Times reported last night that the city had reached a deal with the five men, who were wrongfully accused in the beating and rape of a female jogger in 1989. Their convictions were vacated after DNA evidence exonerated them.

On Thursday, the men wrongfully convicted of the 1989 rape and assault of a jogger in Central Park agreed to a $40 million settlement with the city. The amount corresponds to the roughly 40 total years the men, known Collectively as the "Central Park Five," spent in prison after their conviction. Based on this calculation, Karey Wise, who spent 13 years in prison, the most among the five, will receive the most money the city has ever paid for a wrongful conviction.

The crime was high profile, and so were the trial, the eventual exonerations, and the long battle for a monetary settlement.

When the men were arrested, the city's (and the country's) primary criminal justice concern was public safety. It was the tough-on-crime era. As they reached their settlement, the criminal justice headlines are focused on wrongful convictions. It is an era of reconciliation and of learned lessons.

The expected federal lawsuit settlement between the City of New York and the "Central Park Five" for $40 million would dwarf past wrongful-conviction payouts by the city, plaintiff attorneys said Friday.

The amount—which is subject to the approval of Comptroller Scott Stringer and a U.S. District Judge—works out to almost $1 million for each year each man spent in prison.

"It's a phenomenal result," said Nick Brustin, an attorney who has settled several wrongful-conviction suits and isn't involved in this case. He said it "is right up there with the highest settlement that I've ever seen."

For comparison, in May, Mr. Brustin helped settle a lawsuit for $8.6 million on behalf of an upstate New York man who spent 19 years in prison for a murder he didn't commit.
