Judge with COVID hears lawsuit to suspend 'stay home, stay healthy' order

WENATCHEE, Wash. -- Chelan Superior Judge Kristin Ferrera has a big decision to make. She's being asked to issue a temporary restraining order against Gov. Inslee's “Stay Home, Stay Healthy” order.

Of the several lawsuits looking to pursuing the same outcome, the one brought by Jose Cuevas, a Wenatchee City Council Member and his attorney Joel Ard is the first to be heard in a courtroom.

It's challenging the governor’s authority to issue what Ard describes is a perpetual State of Emergency that could allow the governor to control the actions of Chelan County residents for a long time.

Principally, an argument is that hospitals would be overrun with cases if the governor doesn’t have the power to control what happens in counties statewide.
