"Trump refuses to leave office" - what exactly does that mean?
Almost daily we hear references to Trump refusing to leave office should he fail to win reelection this November.
Do we know how that might play out?
At some point shortly after the election the transition process begins.
For example, the Oval Office is completely stripped down and emptied – including removing the rug down to the bare floor.
President elect Biden along with immediate staff members will start to receive intelligence and other briefings, meet with military leaders, meet with members of the intelligence community, and address Secret Service and other WH security issues.
A series of ongoing meetings will be scheduled between members of the Biden transition team and their opposite numbers in the WH.
Indeed, Trump will be expected to invite president elect Biden to meet with him at the WH.
Biden West Wing staff members will be issued their credentials, assigned to WH phone, email, and network access, and assigned to offices – and they’ll be moving into those offices come January 21, 2021, if not sooner.
The transition from one administration to another will be facilitated by Federal agencies with Federal workers in a robotic fashion, consistent with the law, policy, and over 200 years of tradition – oblivious to a soon-to-be former president ‘refusing to leave.’
Last, plans will be underway for Biden’s inauguration, with members of Congress, the judiciary, the Washington political establishment, and thousands of Americans in attendance.
Given all of this and more, what exactly are the mechanics of Trump ‘refusing to leave’?
The Judiciary is Lost; the Fight Now Moves to the Political Realm
Since Brown v. Board of Education and Hernandez v. Texas citizens disadvantaged by the fear, ignorance, bigotry, and racism of the ‘will of the majority’ have been able to seek relief in the Federal courts to have laws repugnant to the Constitution invalidated in recognition of the rights and protected liberties of those disadvantaged through force of law.
With the confirmation of Kavanaugh that era will come to an end; the right to marry, the right to vote, the right to privacy, and the right to due process of the law are now all in jeopardy, the consequence of a militant social conservative Supreme Court whose majority comprised of rightist ideologues will allow the states to ignore the rights of the people and codify that fear, ignorance, bigotry, and racism.
Now that the judicial process so compromised and corrupted we must move the fight from the courtroom to the ballot box, organize at the state and local level to put elected representatives in place who will acknowledge the rights and protected liberties of the people, and repeal laws and measures hostile to those rights.
This will not be easy to do; for 64 years we liberals have depended on the Constitution and its case law – and a judicial process that respected the Constitution and its case law – to strike down laws enacted by hateful, authoritarian conservatives seeking to compel women to give birth against their will or deny gay Americans their right to access marriage law.
And this will not happen quickly, it will likely take decades to accomplish; but there is no other recourse, we have no other choice but to work to restore our Constitutional Republic and the rule of law.
The Ultimate Tragedy of Trump: the End of Our Constitutional Republic
The United States is a Constitutional Republic, whose citizens are subject solely to the rule of law, not men – as men are incapable of ruling justly; state laws which seek to compel a woman to give birth against her will or deny same-sex couples access to marriage law are evidence of that.
And in our Constitutional Republic our rights and protected liberties are not subject to the ‘will of the people,’ our rights and protected liberties are not determined by ‘majority rule,’ they are inalienable, neither bestowed by, nor subject to, any government, constitution, or man.
This will come to an end before the conclusion of Trump’s first term, the consequence of Trump judicial appointments.
Justice Kennedy will likely be the first, replaced by a hateful, bigoted reactionary conservative hostile to the Constitution and its case law, an adherent to the wrongheaded judicial dogma known as ‘originalism,’ where the states will once again be at liberty to discriminate against women and minorities, whose rights and protected liberties will be lost to the hateful ‘will of the people.’
Last, should a Democratic president be elected in 2020, it will be far too late to repair the damage the consequence of Trump judicial appointments.

Pelosi Is Correct No Impeachment of Trump
Whatever Pelosi’s faults and failings, she’s exhibiting political wisdom in this regard.
The Senate would never convict Trump, and he would go into the 2020 General Election ‘exonerated,’ having put the ‘Russia Thing’ behind him.
Indeed, if Trump were forced out of office Pence would be president – and Pence is worse than Trump; Pence would also have a better chance of winning the presidency in 2020, and we’d be facing a likely 12 years of incompetent Republican rule, something America would clearly not survive.
No, Trump needs to be removed from office by the American people, the same voters who put him in office, where those voters acknowledge that they were wrong in 2016 and have corrected their mistake by electing a Democrat president in 2020.
Trump and the Russia Thing
Last Tuesday Trump addressed Congress in a speech that was tedious, divisive, and dishonest – but because he got through the address without sounding like a deranged buffoon, the media, in their never-ending effort to normalize the idiot Trump, hailed the address as ‘presidential,’ co-workers in my office Wednesday remarked that Trump ‘did good,’ and Trump supporters likely believed that this failed administration had ‘turned the corner’ and was on its way to winning reelection in 2020.
Then it was reported Wednesday that Sessions had lied to Congress during his confirmation hearing, that he indeed had made contact with Russian officials during last year’s presidential campaign, when during his hearing he said he had not.
The ‘Russia Thing’ isn’t going to go away, it will continue to hobble the administration for the foreseeable future, undermining any success it might realize.
And the more the administration continues to oppose efforts to get to the truth, opposes a comprehensive, bi-partisan, objective investigation by a special prosecutor, and continues to lie to conceal Trump’s involvement with Russia, the greater the likelihood the ‘Russia Thing’ ends this administration come 2020.
