1. I think it bypasses Congress
A judge or a commissioner or other official can take action with regulatory law or maybe just pure macho on their side and Congress REACTS. Reacts IF there is an outcry or special interest in this narrow crackdown based on campaign law.

Using laws and offices in place doesn't mean the Congress has to dirty its hands. Protesting after the fact is a defense that measures how much they can get away with the next time or really making new legislation. Bloggers can probably work around the restriction but will feel the shot across their bows along with every other government persecuted group in the nation.

Deep investigation of the power conduit, the single official who makes the hit should be presumed if not pre-emptive as I see is nearly the case this time. I mean deep and fully disclosed information about the individual and his(her) connections as they are relevant to abuse of office and power in concert with the GOP.
