4. Anyone not joining in lockstep to support the policies of those in power

are exposed to the same treatment under the US Patriot Act IMHO to the extent those in power wish to use this tool to make an example out of some poor schmuck, for that power is surely there to be used in their sole discretion. We'll just have to hope those in power don't use these tools as vindicative partisan political rather than national security purposes.
