It says nothing about whether the data collection is happening under color of warrant and with judicial oversight.
And the question simply presumes that the NSA is not listening, recording, etc... We don't KNOW what NSA is doing-- that's been one of the problems all along. NSA refuses to comply with the law, so what other laws are they violating.
And they have lied at every turn. So why believe that they are limiting themselves to looking at calling patterns. I've been hearing that NSA is doing MUCH more than that.
