that said the internet is an unregulated information service. the internet should be a regulated service like phone and content providers should be banned from owning the pipes and vice versa, service providers should not be in the business of controlling content in any fashion. This would restore the 1990s climate of innovation and net neutrality. The FCC could do that tomorrow if they wanted to, no need for the courts.

If I was Genachowski, I would then sue Time Warner, ATT and Comcast if they interfere with content via "quality of service" because at that point the FCC is the regulatory authority in charge and the courts would recognize that the wire is like a phone service where no provider has the right to filter calls based on content. I'd say that's the next news we'll hear on this.
