9. 9th Amendment to the Constitution of the United States

"The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people."

This directly and exactly contradicts the concept that we have no rights except those stated in the Constitution. Madison's initial objection to inclusion of a Bill of Rights ... yes, he ultimately was the guy to submit them, but initially opposed the idea altogether ... was that people would claim exactly what you just did.

Rightists often use that same argument against progressive "activism".
