determines planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored such organizations or persons.” He doesn’t even say that person has to have been rounded up on a battle field, however you define that.
If detaining someone indefinitely is “necessary to protect against a significant threat to the security of the United States,” Obama says, he can do it.
