League of Women Voters won't appeal San Diego mayoral ruling
SAN DIEGO The League of Women Voters of San Diego says it won't appeal a judge's ruling the city's mayoral race.

The decision is another setback for Councilwoman Donna Frye's write-in bid. On Monday, a retired Tulare County judge refused to grant the League's request that the county registrar be ordered to count all ballots cast for Frye _ including those on which voters failed to darken the oval next to her name. The judge said state election law requires that the bubble be filled in on the ballot _ siding with attorneys for Mayor Dick Murphy and County Registrar of Voters Sally McPherson.

Kay Ragan, president of League's San Diego chapter, said today (Tuesday) that appealing would appear like a partisan move on behalf of Frye. The group is nonpartisan.

Frye _ a maverick city councilwoman and surf-shop owner _ came up 22-hundred votes short against Murphy when vote-tallying ended Friday. The League of Women Voters estimates that 4,000 Frye voters failed to darken the oval; an attorney for the Frye campaign says the number could be much higher.

Excerpt from San Diego Union Tribune 
Retired Judge Charles E. Jones was assigned the case, filed Wednesday by the League of Women Voters of San Diego. San Diego Superior Court Presiding Judge John Einhorn signed an order removing all 124 local judges from hearing the case.

Einhorn did so because Mayor Dick Murphy – in a tight vote count with Councilwoman Donna Frye – was a Superior Court judge for 15 years. Einhorn said he excluded the bench in both cases to avoid any hint of bias or impropriety.

Why isn't the league of Women Voters appealing the case? That makes no sense to me. Equity is on their side!

7. The President,, K. Maxwell, refused to endorse the paper audit trail
for those damn voting machines and she got thousands and thousand of emails, and I personally did not renew my dues, and after almost all of her members went against her she endorsed the paper trail. She is a fraud, a republican in heart if not in deed, in my mind.

Stealing votes that are clearly marked is a crime or should be.

6. I disagree w/ the League
To NOT appeal actually comes across as partisan, i.e., rolling over for the status quo.

If a person writes in a name, it is not unrealistic to assume that you don't need to fill in the oval as well.

It's a CLEAR indication of the voter's intent. All of those votes should be counted, regardless of which party it favors.

I am SO disappointed in the LOWV. What a disgrace to themselves.

Have to re-think my contribution this coming year.
