US (Supreme) court shuns gay marriage case
Monday, 29 November

The US Supreme Court has said it will not hear a case that challenges the legality of same-sex marriages.

The judges had been asked to overturn a decision by a Massachusetts court that legalised gay weddings and had been challenged by conservative groups.

The issue has become an important one politically and is widely seen to have helped President Bush win re-election.

The Supreme Court judges did not comment on why they declined to rule on the case, but their refusal is a setback for opponents of same-sex marriage.

2. The conservatives were appealing on a very weak issue
The constitutional issue raised by the idiots trying to get the US Supreme Court to review this matter was very weak and so it was easy for the SCOTUS to duck this issue. These idiots claim that there is a constitutional rights to not have a state supreme court from making rulings they disagree with. This is a stupid argument that had no chance before the SCOTUS.

One of my biggest problems with Bush v. Gore is that normally the federal courts have to defer to the state courts as to state law issues. In order to get Bush appointed, the SCOTUS ignored that principle and in effect told the Florida Supreme Court that it did not know Florida law.

I am glad that the SCOTUS made the right call in in this case.

4. my thinking....
is that it would have opened up a can of worms for the conservatives on the court- that would ultimately have lead, (or will ultimately lead) to a determination that the rights granted to a citizern in one state can't be taken away by another state- constitionally speaking- which would, constitutionallay speaking make all those referenda passed this november unconstitutional, constitutionally .

this isn't a setback. this is the whole enchilada.

5. Traditionally, SCOTUS does not intervene
in state supreme courts' decisions when those courts are interpreting their states' own constitutions. The exceptions are cases in which the state constitution is in conflict with the federal one, eg., Alabama's constitutional provision of segregated school systems will, eventually, fall before the 14th. Amendment to the USC.

They hope to find that "magic" issue that the "Supreme" Court will use to further deny civil rights to homosexual Americans.

8. Right decision, but the worm can is still open
Now we'll see a big push from the right-wingers to pass a constitutional amendment banning gay marriage everywhere, not just in Massachusetts. So don't pop champagne just yet.

11. I don't know if they want the horse to get the carrot
The horse being religious voters and the carrot being gay marriage and/or Roe vs Wade. If the horse gets the carrot, he might stop running.

everybody loves winner as well.
even if the winner is a wacked out religous fanatic{or large group of them} -- more people could line up behind them.

i will never be comfortable with straight people deciding my fate -- like they know what's best for me or society.
