NYT: Colleges Can Bar Army Recruiters
Universities may bar military recruiters from their campuses without risking the loss of federal money, a federal appeals court ruled yesterday.

A three-judge panel of the United States Court of Appeals for the Third Circuit, in Philadelphia, found that educational institutions have a First Amendment right to keep military recruiters off campuses to protest the Defense Department policy of excluding gays from the military.

The 2-to-1 decision relied in large part on a decision in 2000 by the United States Supreme Court to allow the Boy Scouts to exclude gay scoutmasters. Just as the Scouts have a First Amendment right to bar gays, the appeals court said, law schools may prohibit groups that they consider discriminatory.

Billions of dollars are at stake, and no university has been willing to defy the government. Indeed, several law schools that are members of one of the groups that sued to block the law, the Forum for Academic and Institutional Rights, have not been publicly identified. Among the institutions willing to be named are the law schools of New York University and George Washington University. The law faculties of Stanford, Georgetown and several other law schools are also in the group.

A spokesman for the Justice Department, Mark Corallo, said no decision had been made on an appeal.

Yeah, the people that bought them that "right" were considered criminals, activists, and other people that were on the fringe like George Washington, Thomas Jefferson and Ben Franklin.

Yes, it was bought by volunteers who fought and knew exactly what the price was, and exactly what was being purchased.

Yes, all of our uniformed service certainly played a part in the acquisition and ownership of Liberty

THEY BOUGHT FREEDOM

And the folks who stood up to Joe McCarthy, and those who didn't--and were later crushed by blacklisting...

THEY BOUGHT FREEDOM

And Eugene V. Debs and the outspoken socialist critics of World War I...

THEY BOUGHT FREEDOM

And the brave laborers and union organizers who suffered every sort of assault and abuse and injury, yet kept on striking for their deserts...

THEY BOUGHT FREEDOM

And the gays and lesbians who rose up and finally said "No More!" at Stonewall...

THEY BOUGHT FREEDOM

And the Okies and Arkies and all of the rest of the victims of the Great Depression who just took what they perceived as their lot in life, but kept on plugging anyway...

THEY BOUGHT FREEDOM

And the people who have exposed scandals at every level in American politics and business, from Teapot Dome to Enron to The Pentagon Papers to Watergate to Iran-Contra to BCCI to the Bay of Pigs...

THEY BOUGHT FREEDOM

And the civil servants who have foregone higher wages and better opportunities, all in the spirit of public service...

THEY BOUGHT FREEDOM

And the volunteers who sent care packages to the troops, entertained them as well, and collected money for their families, and comforted those families when they lost their loved one...

THEY BOUGHT FREEDOM

And the pastors and preachers and rabbis and priests and mullahs and philosophers that begged their audiences to try and understand all of God's children...

THEY BOUGHT FREEDOM

And the volunteers for any institution in our nation...

THEY BOUGHT FREEDOM

And the feminists who fought for equal opportunity, equal pay, and reproductive rights--not to mention the suffragettes who fought for voting rights...

THEY BOUGHT FREEDOM

And, yes, even to the Blues-Brothers-Hated Illinois Nazis that fought for their right to peacably assemble and demonstrate...

THEY BOUGHT FREEDOM

But most of all, the voters (and non-voters also) of the United States, who exercise their right to make their choice in any matter--OR NOT!

THEY BUY FREEDOM, TOO!



It isn't an exclusively uniformed group, the purchasers of freedom. Please step up and salute them ALL when you get a chance.

If you mean who defended that right, I'd say the law schools know the answer. It's lawyers. :)

2. Will they be investigated now?
Once the bastion independent thought our nations universities have become fat on the tit of public monies. Will the government step in and put guidelines on colleges across the country as they fight for the right for individual action in an age of mass conformism in the B*sh age?

Even with Ashcroft on the wane, will the powers that be allow this to get by unpunished?
