ABCNews: US Group to file War Crimes Charges in Germany
Nov 29, 2004 - BERLIN (Reuters) - Lawyers acting for a U.S. advocacy group will Tuesday file war crimes charges in Germany against senior U.S. administration officials for their alleged role in torture at Abu Ghraib prison in Iraq.


"German law in this area is leading the world," Peter Weiss, vice president of the New York-based Center for Constitutional Rights (CCR), a human rights group, was quoted as saying in Frankfurter Rundschau newspaper's Tuesday edition.


According to the group, German law allows war criminals to be investigated wherever they may be living.

1. I guess the shit is about to hit the fan then...unfortunately, BushCo will
probably get away with this, just like they get away with everything else. But I support the CCR fully in this matter.

5. Well, considering I am not a lawyer and do not play on on TV...
I figure charges are filed, then an investigation leading to either a bill or no-bill of indictment takes place.

This could take years. There is also a real chance that the charges will not be accepted.

But if a bill of indictment is handed down, the countries that a hell of a lot of people in the admin can travel to all of a sudden gets real small.

You see, there are these things called "treaties"...

7. Anybody familiar with international law?Does this mean anywhere in the EU
Bush and whoever else they indict can be arrested and held? Of course if the charges stick.

on war crimes? and crimes agains humanity? It would be interested for local police to bust in on a meeting and say we have a warrant for your arrest for war crimes and for violation of the Geneva Convention..WOuldnt that be something especialiy on natinal tv. Oh well we can only dream

9. diplomatic immunity
I think that i remember that in Belgium you can also arrest foreign nationals accused of war-crimes or crimes against humanity but I'm not sure how diplomatic immunity works in these circumstances.
I remember a few years back that Mugabe was visiting Belgium and the authorities were saying that there was no way they were gonna arrest him, even he had been found guilty of some crime against his own people.
And then there is the case of Pinochet who had a nice little holiday in England before being sent back to Chile without ever being confronted by a judge.
