Man Who Served Nearly 17 Years in Prison Released After DNA Tests Clear Him

EL PASO, Texas (AP) - A man who served nearly 17 years for rape was freed from prison Tuesday after DNA tests determined he was not responsible for the crime.


Brandon Moon, 43, joined his parents, Frank and Shirley Moon, for the drive to their home in Kansas City, Mo., following his release from the El Paso County jail. He said he felt "numb."

"Have you ever had Novocain? It's a lot like that, just from head to toe," he told The Associated Press.

Moon had been serving a 75-year sentence after his 1988 conviction for sexual assault. The El Paso district attorney and defense lawyers filed a successful joint motion to vacate the conviction.

...Didn't Texas used to be one of many states that used to give the death sentence for rape? And some say no innocent man has never been put to death? To them, I say bull.

1. The Harris County Prosecutors office has been destroying old
evidence from cases to make room for new evidence. Many innocent people will never have the opportunity to be exonerated because their evidence has been lost.

4. The more stories like this I read...
the more I am against the death penalty. How many innocent men (and woman) has Texas executed? The Shrub could only issue a stay. He could not commute a death sentence. But he didn't give a shit anyway.

What is more wrong? Abortion or the death penalty?

5. Texas recently executed an innocent man.
That terrible story about the man who was convicted of arson when his three little girls died in a fire. The evidence used to convict him was based on theories of arson that are outdated. Still, he was refused a new trial, and the Governor refused to pardon him.

I'm shocked that the DA also filed a motion to vacate the conviction, especially in Texas. They usually maintain they were right, even in the face of hard evidence to the contrary.

6. It's not usually a DNA-issue...
It's usually a race or class issue. If you don't have money or you're not the right color, you're not given fair treatment. Hopefully it will get harder and harder for the thugs in blue to wrongfully imprison innocent people with DNA because it's hard evidence for the juries to ignore.

How many innocent people are still sitting in our jails?
It's a good thing that the Christian Fundamentalists don't consider DNA research to be against the teachings of God.

we gave this guy room and board for 17 years and for what? Just to let him go? Rapists don't deserve appeal after appeal dragging on for decades. :eyes:
