SD UT: Trial in challenge of San Diego mayor's vote to start next week

SAN DIEGO – A state judge on Monday set a Jan. 31 start date for a trial to determine whether Dick Murphy should be ousted as San Diego's mayor and replaced with write-in candidate Donna Frye.

Orange County Superior Court Judge Michael Brenner ruled in two lawsuits that say the San Diego County registrar of voters wrongfully disqualified ballots on which voters wrote Frye's name but failed to darken the adjoining optical-scan bubble.

Brenner also ordered the registrar to produce the disputed ballots. Attorneys for Frye supporters say a tally showed 5,547 Frye ballots with empty bubbles – enough to overcome Murphy's 2,108 margin of victory in the Nov. 2 election which saw about 460,000 votes cast.

1. Frye backers are prepared to take this to the State Supreme Court.
A new group is forming for the purpose of raising funds for this legal effort. I will be posting a notice in the California section at DU in the next few days with details.

6. Yes, this last Wednesday Donna Frye
... had organized a letter stuffing campaign, presumably to get out letters for this campaign that will be coming shortly. Shook her hands and said hello and thanks for her dilligence at the Progressive Inaugural ball on Friday night.

Though it was disappointing to see Aguire's opinion coming out that opined that these votes shouldn't be counted. I'm guessing that he's trying to look "neutral" in the wake of his other investigations of the pension scandals, etc. going on here, where he's issuing a lot of other opinions, subpoenas, etc.

7. I loved Donna's story at the counter-inaugural ball...
about how City Council members tried to redefine "land" and "water" for a development deal. "When they tell you that the middle of a riverbed is land, don't believe it," she urged, drawing an analogy to the doublespeak used by the GOP at the national level. "Believe what you know is true."

4. i live in murphey's neighborhood
at least once i week i do my best to stick a sign right across from his house letting him know that he doesnt respect the peoples voice and we won't stand for it. if frye doesnt become mayor i think i am going to have to sit outside his house in protest.

5. At the MLK parade last week, when Murphy's name was
called out and the announcer asked the crowd to give him a round of applause, there was stone-cold silence.

San Diegans know he is not the legitimate mayor.

8. The judge has ordered the ballots be produced.
That was in today's hearing. Trial is set to start 1/31.

9. An updated article today

A "statewide" election to get state rules to overrule municipal rules? Please! I know many here in San Diego county in unincorporated parts that weren't able to vote on the mayor's race! It was a *local* election! Give 'em hell Woocher and Donna!
