New York Court Rules Gays Must Be Allowed To Marry

A New York State court ruled Friday that same-sex couples must be allowed to marry.

State Supreme Court Justice Doris Ling-Cohan said that the New York State Constitution guarantees basic freedoms to lesbian and gay people, and that those rights are violated when same-sex couples are not allowed to marry.

In NY, the state Supreme Court is actually the lowest on the totem poll. Court of Appeals are the poohbahs.

The appeals courts are federal. I could be wrong though...

This is great news! It means the only wat to overturn IS to go Federal, and that would be trampling all over us New Yorkers STATES RIGHTS.

NY court structure is different than most. On the state level, Supreme is the lowest, Court of Appeals is the highest, and there's another in between, IIRC.

I'm not trying to dampen anyone's enthusiasm, just saying there's a ways to go yet.

Seriously though, I think the NY courts will still do the right thing and uphold this ruling...

DOMA FAILED 4 times in New York with REPUBLICAN controlled legislature. The marriage laws, which fall under the Board of Health, define marriage as between BRIDE and GROOM. Who is a bride and who is a groom? Doesn't specially say MAN and WOMAN. The marriage laws also talk about spouses. Again, subject to interpretation too.

There has NEVER been any attempt here to have a citizen vote on this. I don't think the politicians here want to touch this issue, INCLUDING REPUBLICANS. Even "Saint Rudy" has publicly said on many, many occasions he is in favor of gay marriage, although certainly NOT as Bush's poster boy during the reelection campaign.

We shall see.

Is this the state supreme court or a lower court in the state making this ruling? And does it effect the entire state or just a region?

Is anyone here familiar with the judges on the court of appeals? Any idea what they might rule?

It is the trial level court.

The Appelate Division is the intermediate level court

The Court of Apppeals is the highest level court in NYS.

There are several appeals to be filed -- and you can bet they will be.

I'm of the opinion those nice couples are going to be waiting at least a few more years -- assuming they manage to win at all.

And let's not forget, Bushie and his fascist buddies are angling for a U.S. Constitutional amendment which would trump all of this.

provide Civil Union contracts to any two individuals who want to join their households.

Let Houses of Worship be the ones to "Marry" people according to whatever doctrine they hold.

This upholds seperation of Church and State.

It also recognizes there's a difference between a legal marriage done in accordance with State Law and those done in the confines of a Religion.

the state provides a bunch of benefits depending on marital status. I agree states should allow gays/lesbians to marry but there have to be some rules enforced by the state or you could end up with, say, bigamist or polygamist marriages.

ideally would be a civil union was done by state & marriage done by church.

At least that's my suggestion.

And I concur that marriage needs to be reserved for the religious sphere.

When one is oppressed we all are.
