.......Yet by evening the Schindlers were trying another avenue, sending their lawyer back to Judge James D. Whittemore of Federal District Court in Tampa with an amended lawsuit charging that the removal of the feeding tube had been a violation of Ms. Schiavo's constitutional right to life.
"We hope to save Terri's life," the lawyer, David Gibbs, said as he arrived at the federal courthouse. "This could be it, so let's pray. We think there is some new ground and we are going right to the heart of the matter."
In a three-hour hearing before Judge Whittemore, Mr. Gibbs argued Thursday night that every person was entitled to life under the 14th Amendment and that "life can't be denied." He said he had new expert witnesses who could provide valuable evidence in a new trial, and he asked the judge to prolong Ms. Schiavo's life for at least 30 days. At the very least, Mr. Gibbs said, the judge should order that Ms. Schiavo receive intravenous fluids over the next few days while he considered their case.
"Give us enough time to keep Terri alive," he said.
Judge Whittemore did not rule from the bench but said he would remain in the courthouse until he reached a decision. A spokeswoman for Governor Bush said he was also looking for options, after failing to persuade Judge George W. Greer of Pinellas-Pasco Circuit Court to allow him to intervene. Judge Greer also barred state officials from seizing Ms. Schiavo......
