Sensenbrenner To Cable Execs: Indecency Is Criminal Act

SAN FRANCISCO -- The chairman of one of the entertainment industry's most important congressional committees wants to take indecency prosecutions into the criminal realm.

Rep. F. James Sensenbrenner III, R-Wis., told cable industry executives attending the National Cable & Telecommunications Assn. conference here on Monday that criminal prosecutions would be a more efficient way to enforce the indecency regulations.

"I'd prefer using the criminal process rather than the regulatory process," Sensenbrenner told the executives.

The current process -- in which the FCC fines a licensee for violating the regulations -- casts too wide a net, he said, trapping those who are attempting to reign in smut on TV and those who aren't.

"People who are in flagrant disregard should face a criminal process rather than a regulatory process," Sensenbrenner said. "That is the way to go. Aim the cannon specifically at the people committing the offenses, rather than the blunderbuss approach that gets the good actors."

7. That would actually be an improvement, civil rights-wise.
Regulatory enforcement procedures are an absolute joke. No jury. No preseumption of innocense. No evidence rules. If the regulatory agency sanctions you, you have a theoretical right to defend yourself, but to win you have to have a hearing before the same agency that sanctioned you, and you basically have to prove that you were innocent and they were wrong to cite you. Meanwhile, you are subject to their regulatory scheme and they take retribution on you for daring to defend yourself.

In a criminal case, on the other hand, there would be an independant judge, and a jury, and they'd have to prove their case.

I have worked on federal regulatory enforcement cases, and I have worked as a criminal defense attorney. Criminal defendants get a much more fair deal.

If the dealings of the FCC are an indicator, the GOP doesn't seem capable of applying those rules fairly. Seems they have double standards when it comes to obscenity on liberal vs conservative stations. Just an oversight, I'm sure.

that cable and satellite channels are still something you have to pay for. It might sound crazy to the unitiated, but people who subscribe to cable/satellite TV can even choose the channels they get, too! It isn't as if people are being forced to view hardcore porn by subscribing. Dumbasses.

Ayatollah Jimmy says that since most of the Murkan Sheeple have NO grasp of technology whatsoever, the impression is that shit coming in over the public airwaves and shit through a privately-owned, paid-for wire are the SAME THING. Thus, Congress, through the FCC, needs jurisdiction over Cable the same way that they "control" the Air...

Sheesh, why not just tell the Sheeple to stick more magic 9-11 teddy bears dressed like angels on top of their Teeeee-Veeeeees. Might work better. or better yet, get the J2-P2 model....

one pays for cable. One doesn't have to have cable. One may block what they don't like viewing. One can turn one's TV off-they all come equipped with an off button.

According to OpenSecrets.org, Sensenbrenner got $10,000 from a Time Warner PAC for the 2004 election cycle. Time Warner Cable offers pornography via pay channels and pay-per-view, presumably at a considerable profit. Thus Sensenbrenner hypocritically profits from pornography.
