WEST PALM BEACH, Fla. (AP) -- A judge ruled that a 13-year-old girl at the center of an abortion fight with the state may terminate her pregnancy, and Gov. Jeb Bush said Tuesday that the state will not appeal further.

Juvenile Judge Ronald Alvarez ruled Monday that the teen, who has been in state custody for four years, would not be physically or emotionally harmed by the procedure. Last week, Alvarez blocked the girl's abortion until a psychological evaluation was completed.

A state agency may take Terri Schiavo into custody while it investigates allegations of abuse and neglect by her estranged husband Michael. The Miami Herald newspaper reported that state officials are considering taking the action so Terri's can receive food and water before she dies.

Florida DCF secretary Lucy Hadi told the Palm Beach Post newspaper that her staff is relying on a state law giving authority to intervene on behalf of a vulnerable adult "suffering from abuse or neglect that presents a risk of death or serious physical injury."

Hadi said a petition must be filed with local courts to remove Terri from Woodside Hospice, where she lives, but that the agency could remove her without approval if it feels such action is warranted to protect her life.

"We're not compelled to look at prior judicial proceedings," Hadi told the Post. "What we're compelled to look at is the presenting circumstance and any allegation of abuse and neglect that we've received. So we have to deal with those and fulfill our statutory responsibility, notwithstanding anything else that may have gone on before."

And was gone for a few weeks.

The state claims they contacted authorities as soon as she ran away, but refuses to provide evidence they did.


The real question is not how she turned up pregnant, but how she turned up pregnant while under the care and protection of the state of Florida.

If she doesn't get lost, starved or beaten to death the baby might just end up simply nonfunctional and pregnant as a child, to give birth to another foster baby.....

The police said they weren't notified.

dept let her run away which resulted in pregnancy!

The DCF dept has been seriously mismanaged and poorly funded. Remember 5-year-old Rilya Wilson?

When Florida ranked 36th among the 50 states in 1999 for key indicators of children's well-being. Oklahoma ranked 40th. Its secretary of Health & Human Services at the time was Jerry Regier, which was exaclty the man Bush tapped to head Florida's Department of Children & Families. Oh by the way....Jerry Regier is an evangelical Christian who views spanking that causes ''bruises or welts'' as acceptable punishment. He resigned from the Florida DCF in Aug, 2004, six weeks after apologizing for fraternizing with lobbyists who did business with the agency.

Fighting this abortion would only highlight the situation at Jeb's DCF even more and possibly throw his his buddy into the limelight.

66. Nope, Florida's a "Not Under 16" state.
16+ is legal, but there's no age exemption for minors 15 and lower to legally have sex. If a 12 year old male sleeps with a 14 year old female, the male can be sent to jail for statutory rape.

As Baby Sun Hudson could have told you, thanks to a law Texas governor Dubya Bush signed. His mother was a woman of color and poor, and he was unplugged the week before Dubya interrupted his vacation to sign Terri's Law.

Why would the state decide for the girl that she is too young to have an abortion but not too young to be a mother?

Do the state consider her mature enough to bear the responsibilities of a mother?

Whenever I hear a state deciding for someone what he/she could do with his/her body I go really mad.

Incredible...to think that the so called "Pro-lifers" would rather risk this young 13 year olds health and life to carry a baby full term (only to then take it away and shove it in the same system that let this 13 year old in their "care" who had runaway and got pregnant) is disgusting!

To think that they would not allow her to make that decision for her own health and well-being is disgusting and just proves that they care more about the fetus than about living beings breathing the air after birth.

I too get crazed at the idea of anybody, especially Government deciding what a person can and should do with his or her body and medical decisions.

is. She ran away from foster care - perhaps from one of her care givers? If a male member of her foster family is responsible then the state of Florida (once again) is responsible for bad treatment of children in their care.

Some days I wish Florida would have a major earthquake - the result being that the entire state broke off from the mainland and it floated out into the ocean and became an independent country. Nothing about Florida seems to reflect its association with the U.S. I have been referring to it as a third-world country for many years. Several of my relatives live there and agree.

33. A similar thought occurred to me.
Once the identity of the father became known the whole issue needed to be disappeared. There is insufficient interest in bringing the pervert to justice, which is telling all by itself. It is telling because either the misogynist right wing wacko "Christian" culture believes that men aren't responsible to control their urges or because the particular man isn't someone who is accountable for crimes, or both.

29. this girl provided the most articulate, direct, powerful arguments i've
seen on her own behalf in front of the judge, and she did it in a non-combative, respectful way. if anyone had wanted to fight her on this, i would have welcomed the opportunity to see her rebuttal.

They shouldn't have been involved in the first place. Keep your eyes on the problem here, the legalities of what Jeb/etc were trying to do and don't get distracted by who the father was because that's just distraction stuff. The issue of how kids in state care get treated is another good issue to work on, but let that be another issue and lets finish off reproductive rights here first.

Let's see Randall Terrell and hannity and Rush rip Jeb a new one. yet you know they won't because they've already worked out their gameplan and that is to quickly get this behind them.

Fighting the abortion would only highlight the fact that "HIS" DCF dept let her run away which resulted in pregnancy! It would also result in scrutiny of the agency in general plus possibly throw his buddy (who ran the dept)into the limelight.

When Florida ranked 36th among the 50 states in 1999 for key indicators of children's well-being. Oklahoma ranked 40th. Its secretary of Health & Human Services at the time was Jerry Regier, which was exaclty the man Bush tapped to head Florida's Department of Children & Families. Oh by the way....Jerry Regier is an evangelical Christian who views spanking that causes ''bruises or welts'' as acceptable punishment. He resigned from the Florida DCF in Aug, 2004, six weeks after apologizing for fraternizing with lobbyists who did business with the agency.

"Why can't I make my own decision?"

That was the blunt question to a judge from a pregnant 13-year-old girl ensnared in a Palm Beach County court fight over whether she can have an abortion.

"I don't know," Circuit Judge Ronald Alvarez replied, according to a recording of the closed hearing obtained Friday.

"You don't know?" replied the girl, who is a ward of the state. "Aren't you the judge?"

Against a backdrop of state and federal efforts to pass a parental notification law for teen abortions, the exchange was typical of L.G.'s pluck as she argued that she had the right and capability to make her own decision, despite a move by the Department of Children & Families to seek a judge's permission for her abortion.

"I think if I want to make the decision, it's my business and I can do that," she told the judge.

HOw many kids have they lost track of? Apparently this young lady was one of them. And they think it is in her best interests to have a baby at the age of 13 rather than having an abortion? All of this on the Jebster's watch, also. Will Randall Terry be saying more nasty things about Jeb now? I love it when the RW fundies are at each other's throats.

A pregnant 13-year-old girl in Florida has been allowed to have an abortion after a legal battle over the issue........


Florida Governor Jeb Bush said the state would not fight the judge's decision, but expressed sadness about the situation.

"It's a tragedy that a 13-year-old child would be in a vulnerable position where she could be made pregnant and it's a tragedy that her baby will be lost......


It is not clear if she has had the abortion.......

89. Jeb Bush is no idiot.
He got burned by the fundies on the Schaivo case and now again here he is with another one of those pesky "grey and grey" issues.

His agency screwed up with this girl in the first place and to force her to go through with the pregnancy would just keep that inconvenient fact in the news until the baby is born.

Hopefully the fundies will howl. Most people will agree that a 13 year old getting pregnant is a trajedy and that in this case an abortion is probably the best choice and that arguing the case further will only delay the inevetable and force the girl into a late-term abortion.
