AUSTIN — An attorney for U.S. Rep. Tom DeLay is trying to prompt a response from prosecutors who have not yet answered several motions that are to be argued in court next week.

DeLay's legal team has filed requests to dismiss the money laundering and criminal conspiracy charges against the former House majority leader. But, prosecutors who brought the charges against DeLay have not yet responded to the motions, which are expected to be addressed during a hearing today.

Attorney Dick DeGuerin asked visiting Judge Pat Priest to set a noon Friday deadline for District Attorney Ronnie Earle's office to file their court briefs.

1. Funny.
Reelection coming up too. The last thing bugman wants is a trial in to next year. Earle's gonna try to string this out as long as possible.

3. Heehee!
Having worked in the legal field in Travis County, the DA's office has until Monday to file their response (14 days from the date the Motion was filed which was Nov. 7). If Delay's attorneys were stupid enough to schedule a hearing for the day after Earle's responses are due that's their problem. And, Earle's no dummy. Any good attorney would wait until the last possible time to file their responses because it gives the opposing side less time to come up with replies and prepare for hearing.

By requesting the Judge move up the deadline to a date prior to when Earle's response is due, they are asking the judge to blow off the Texas Rules of Civil Procedure. Were the judge to grant that, it would definitely be a decision subject to appeal by Earle.
