Government fails to block Iraqi death inquiry

The Government must hold an "independent and effective" inquiry into the death of an Iraqi hotel receptionist who died in British military custody in Basra, the Court of Appeal ruled this morning.

The appeal judges upheld a decision made by the High Court last December that the European Convention on Human Rights did apply in British prisons in Iraq, and that the Ministry of Defence must launch an independent investigation into the death of Baha Mousa, 26, who died two days after being arrested in September 2003.

"This has very important implications, as otherwise violations of human rights by the actions of UK officials and agents around the world could only be remedied by cases taken to the European Court of Human Rights," he said.

At their court martial, due to be convened next September, the former commander of the Queen's Lancashire Regiment, Colonel Jorge Mendonca, will also be tried for negligence.
It emerged yesterday that Colonel Mendonca, the holder of the Distinguished Service Order, has been selected to attend a highly regarded military staff college aimed at grooming the next generation of generals. Colonel Jorge Mendonca is to start at the Higher Command and Staff Course next month.
