Bush's counsel on spying now under close scrutiny

WASHINGTON -- When President Bush sought to reassure the country that his authorization of spying on Americans without warrants was a reasonable exercise of his power, he emphasized that his orders were always reviewed by the attorney general and the White House counsel.

''Each review is based on a fresh intelligence assessment of terrorist threats to continuity of our government and the threat of catastrophic damage to our homeland," Bush said in his Dec. 17 radio address. ''The review includes approval by our nation's top legal officials, including the attorney general and the counsel to the president."

The current occupants of those jobs are Attorney General Alberto Gonzales and White House counsel Harriet E. Miers. Prior to 2005, Gonzales was White House counsel and John Ashcroft was attorney general.

The current dispute over whether the president had the authority to order domestic spying without warrants, despite a law against it, has put new focus on the legal officials who have guided Bush. And the qualifications of Ashcroft, Gonzales, and Miers could become a focus of the upcoming Senate hearings on the spying decision.

1. This is good news.
I don't think these people are as tough as they seem. I know the PNAC was real "tough talk" about ruling the world, calling ourselves the "Benevolent Dictator" as if there is such a thing. Trust me, there isn't.

It's absolutely fantastic that the magnifying glass is there. They're under scrutiny.....under the microscope. People are watching, taking notes, forming opinions.

As they hide out, they hope to escape the close look. The beads of sweat form on their foreheads. The lies. The near-lies. The damnable lies. The ones that can get them caught. Oh, shit.

As they reach for the drink, they all have Hurricane Katrina's in their heads. They lay in their beds at night, trying to get some sleep.....

But the scrutiny continues, and the paranoia grows......

7. Since the media (reporters) are considering they may
be under surveillance, not just the terrorist, that could make a big difference in the reporting of this story. Help may be on the way.

2. The important words are
"continuity of our government." The our in this case really is the rethugs providing justification for spying on all who oppose them. Did * accidently tell the truth?

3. It would be funny if it wasn't deadly serious.
I can just imagine Bush saying, "My underlings approved it, therefore I did it, even though there's a law against it."

4. ...his orders were always reviewed by the A.G. and the W.H...
So before the fox enters the hen house, he checks to make sure it's o.k. with the weasal and the snake?

6. Really there is no reasonable argument for legality...
...despite how they try to spin it. Their arguments have been litigated and discounted in the past. Honestly, isn't this the second time Gonzales has come up with less than scholarly arguments to justify improper behavior? This is weak first-year law stuff. This is not head-attorney-of-the-nation stuff.

And Ashcroft: well. Enough said.

So, either they are completely incompetent or they think we are too stupid to care cause they are riding their horses with white hats protectin us from the bad guys.

8. Trying to spread it around
take the heat OFF BUSH.. remember, it's always somebody else.. interesting that HIS choice of Supreme Court person told HIM to break the law, specifically use the Constitution as TOILET PAPER..

They'll bring in all these bozos, NOT under oath, put on a dog and pony show and then it will slowly slide to the back of the paper..

We need Fitzgerald on THIS as well, an independent investigator.

9. He has no such power. This is a usurpation, an attempted coup.

The Constitution is the only legal source of his
legitimacy, and the Constitution says clearly that he
cannot do this. Never mind the drivel that emits
from the Congress, which also says he cannot do this.
