Libby Wants to Use Classified Evidence

Lawyers for a former top aide to Vice President Dick Cheney on Monday made their first request to use classified evidence at his trial, launching a highly secretive court process that could bog down the case.

In the filings made under seal in federal court, lawyers for I. Lewis "Scooter" Libby put the judge and prosecutors on notice that they want a jury to hear evidence the government now says is classified.

Although the specifics of Monday's filing remain secret, Libby's defense team hinted in a court document last Friday that they will want to disclose to a jury the nature of Plame's work as a CIA operative.

Libby's lawyers said Plame's now-classified duties are among the "significant disagreements" they have with special prosecutor Patrick Fitzgerald, an issue they believe is "material" to the defense's case.

1. WHoa... Hold On Here...
So essentially they are admitting they outed a CIA Agent because of the nature of her operation? So they outed her to stop what she was doing. WTF!

This is much worse than outing a CIA Agent due to retaliation.

3. nah, sounds to me like an obvious delaying tactic
all they have to do is show that the classified evidence is relevant enough so that it has to be heard. there will be motions back and forth, delays, delays, etc. eventually the evidence will be heard and it may OR MAY NOT amount to anything of consequence. that remains to be seen.

the only part that's clear right now is that they are delaying the process, which is to be expected.

10. I don't see it that way.
He is charged with obstuction and perjury. I can't see why you would need classified information to prove or defend those charges. It is more likely a delay tactic, because they will run it all the way up to the SC.

.... far enough out that a pardon can come from bush as he leaves office.

7. I trust that Fitzgerald anticipated this defense
The basic premise was that Plame was a NOC. It does not seem probable that a man with a reputation for almost obsessive attention to detail, would not have anticipated this defense.

Let Libbly show all the cards--next? Rove. The cards will have been played, and Fitzgerald can set up his next indictment accordingly.

If not, well I have this to say--our system of justice for these white collar creeps who think they can escape it with high paid lawyers, is insufficient to protect the American people.

And a desperate one. If they want to show evidence about her that is classified, that only underscores the nature of her status as covert. It underscores the potentially criminal nature of the leak and goes against the exoneration they are looking for.

They must be stalling or pressuring affiliated parties or both.
