Federal Judge Refuses To Dismiss Nebraska DOMA Challenge

A constitutional challenge to a Nebraska law that not only bans gay marriage but also prevents the state from providing any benefits to same-sex couples will proceed to trial a federal judge ruled Monday.

While 34 states have so-called Defense of Marriage Acts, Nebraska's is the only one which prevents gay couples from receiving any of the benefits married couples enjoy.

It was passed with 70 percent of the vote in 2000 and added to the Nebraska Constitution the following year
