A panel of federal judges Friday let stand a Nevada Supreme Court decision blocking a state constitutional amendment requiring a two- thirds majority vote on a tax plan.
The judges said it was a state Supreme Court matter and the federal court had no jurisdiction. They said appeals should be directed to the U.S. Supreme Court.
Last week's unprecedented ruling by the Nevada Supreme Court directed the Legislature to pass a tax plan to fund public education and other state services with a simple majority vote, breaking an impasse that has extended through one regular and two special legislative sessions.
Republican Gov. Kenny Guinn, who favors a tax hike, had requested the state Supreme Court's intervention after legislators deadlocked on the plan needed to balance a nearly $5 billion two-year budget.
The state court's decision, however, was challenged by GOP lawmakers and a host of Nevada residents, who filed petitions in federal court in Las Vegas and Reno.
